Groups Sue EPA Over Dangerous Drilling and Fracking Waste

Call for Rules for Handling and Disposal of Oil and Gas Waste to Prevent Earthquakes, Drinking Water Contamination. A coalition of community and environmental organizations filed a federal lawsuit against the U.S. Environmental Protection Agency calling for regulations to stop oil and gas companies from disposing and handling drilling and fracking wastes in ways that threaten public health and the environment.
The organizations are pushing EPA to issue rules that address problems including the disposal of fracking wastewater in underground injection wells, which accept hundreds of millions of gallons of oil and gas wastewater and have been linked to numerous earthquakes in Arkansas, Colorado, Kansas, New Mexico, Ohio, Oklahoma, and Texas.
“Updated rules for oil and gas wastes are almost 30 years overdue, and we need them now more than ever,” said Adam Kron, senior attorney at the Environmental Integrity Project.  “Each well now generates millions of gallons of wastewater and hundreds of tons of solid wastes, and yet EPA’s inaction has kept the most basic, inadequate rules in place. The public deserves better than this.”
The groups filing today’s suit include the Environmental Integrity Project, Natural Resources Defense Council, Earthworks, Responsible Drilling Alliance, San Juan Citizens Alliance, West Virginia Surface Owners’ Rights Organization, and the Center for Health, Environment and Justice.
The lawsuit, filed in the U.S. District Court for the District of Columbia, calls on the court to set strict deadlines for EPA to comply with its long-overdue obligations to update waste disposal rules that should have been revised more than a quarter century ago.
Amy Mall, senior policy analyst at the Natural Resources Defense Council, said: “Waste from the oil and gas industry is very often toxic and should be treated that way.  Right now, companies can get rid of their toxic mess in any number of dangerous ways—from spraying it on icy roads, to sending it to landfills with our everyday household trash, to injecting it underground where it can endanger drinking water and trigger earthquakes. EPA must step in and protect our communities and drinking water from the carcinogens, radioactive material and other dangerous substances that go hand-in-hand with oil and gas waste.”
The organizations are urging EPA to ban the practice of spreading fracking wastewater onto roads or fields, which allows toxic pollutants to run off and contaminate streams. And EPA should require landfills and ponds that receive drilling and fracking waste to be built with adequate liners and structural integrity to prevent spills and leaks into groundwater and streams.
The groups filed a notice of their intent to sue EPA last August, warning the agency a lawsuit would follow unless it complied with its duty under the Resource Conservation and Recovery Act (RCRA) to review and revise the federal regulations and guidelines governing how oil and gas waste must be handled and disposed. RCRA requires that EPA review the regulations and state plan guidelines at least every three years and, if necessary, revise them. The agency determined in 1988 that such revisions of the regulations were necessary to address specific concerns with oil and gas wastes, yet has failed to meet its legal responsibility to act for nearly three decades.
Background
Over the last decade, the oil and gas industry’s fracking-based boom has produced a vast amount of solid and liquid waste. Each well produces millions of gallons of wastewater and hundreds of tons of drill cuttings, which contain contaminants that pose serious risks to human health. These include known carcinogens such as benzene, toxic metals such as mercury, and radioactive materials. However, the current RCRA rules that govern oil and gas wastes are too weak because they are the same rules that apply to all “non-hazardous” wastes, including household trash.
As a result, oil and gas companies are disposing, storing, transporting, and handling these wastes in a number of troublesome ways. These include: spraying fracking waste fluids onto roads and land near where people live and work; disposing of billions of gallons of oil and gas wastewater in underground injection wells; sending the drill cuttings and fracking sands to landfills not designed to handle toxic or radioactive materials; and storing and disposing of wastewater in pits and ponds, which often leak. Across the U.S., there are numerous instances of wastes leaking out of ponds and pits into nearby streams and the groundwater beneath, and operators often “close” the pits by simply burying the wastes on site.
Aaron Mintzes, Policy Advocate for Earthworks, said: “In 1988, EPA promised to require oil and gas companies to handle this waste more carefully. Yet neither EPA nor the states have acted.  Today’s suit just says 28 years is too long for communities to wait for protections from this industry’s hazardous waste.”
The following are some examples of problems caused by the improper disposal and handling of fracking and drilling waste:

  • Ohio: Underground injection wells in Ohio accepted 1.2 billion gallons of oil and gas wastewater for disposal in 2015, more than double the amount in 2011. Half this wastewater came from out of state. This has resulted in scores of earthquakes in the well-dense Youngstown area, with one well alone linked to 77 earthquakes. The Ohio Oil and Gas Commission has stated that regulations “have not kept pace” with the problem and that (to an extent) both the state and industry are “working with their eyes closed.” Other states that have experienced increased seismic events in the proximity of injection wells include Alabama, Arkansas, Colorado, Kansas, New Mexico, Oklahoma, and Texas.
  • Pennsylvania:In May 2012, a six-million-gallon industrial pond holding fracking wastewater in Tioga County leaked pollutants, including arsenic and strontium, through holes in its liner into groundwater and a nearby trout stream.
  • West Virginia:Oil and gas wastewater dumped or spilled in rivers in West Virginia and Pennsylvania contains high levels of potentially hazardous ammonium and iodide, according to a study by Duke University scientists.
  • North Dakota:In January 2015, three million gallons of drilling wastewater spilled from a leaky pipe outside Williston, polluting a tributary of the Missouri River. In July 2011, a pipeline serving a well in Bottineau County leaked over two million gallons of fracking wastewater, damaging 24 acres of private land.
  • Colorado:A contractor for a pipeline services firm gave a detailed account of sand-blasting pulverized waste buildup (called “scale”) from pipeline seals directly into the air outdoors without a filter, even though such dust can be radioactive and cause damage to lungs.
  • Across the Marcellus region:Over the past several years, landfills in states around the Marcellus shale formation—even in New York, where fracking is prohibited—have experienced increasing shipments of drill cuttings that contain high levels of radiation.  Many of the landfills do not test for radiation and do not have adequate controls to prevent the often toxic and radioactive “leachate” from seeping into groundwater.

Julie Archer, project manager at the West Virginia Surface Owners’ Rights Organization, said:  “Although West Virginia has taken some steps to improve regulation, the state’s approach has been to permit horizontal drilling without carefully considering whether current methods of waste disposal are appropriate or adequate. It’s past time for the EPA to provide clear guidance on how these wastes should be handled to protect our communities.”
Teresa Mills, director of the Ohio field office for the Center for Health, Environment and Justice, said: “A major reason for the industry’s use of injection wells to dispose of toxic fracking waste is the low disposal cost.  We reject this reasoning because the public’s health and safety must come first.”
EPA’s current regulations do not take into account the dangerous contents of oil and gas wastes or their unique handling and disposal practices. Since 1988, the agency has acknowledged the shortcoming of its basic rules for solid waste management and has indicated that it needs to create enhanced rules tailored to the oil and gas industry. However, the agency has yet to take any action to develop these updated regulations.
Dan Olson, Executive Director of the Colorado-based San Juan Citizens Alliance, said: “As an organization representing hundreds of families living in close proximity to oil and gas operations, we see not only the physical pollution, but also the psychological toll that oil and gas waste exacts on communities. That the EPA is 30 years overdue in creating common sense rules for managing toxic waste from oil and gas operations is a cause of great concern for everyone living near these sources of improperly regulated industrial pollution.”

“The worst environmental disaster since the BP oil spill”

Today, California Governor Jerry Brown declared a State of Emergency over a methane leak that has been flooding the Los Angeles suburb of Porter Ranch for the past several months. The leak, which began in October, stems from a damaged pipeline operated by Southern California Gas Co. The company is still unsure of how to stop the leak, which is likely to continue sickening nearby residents and contributing immensely to greenhouse gas outputs for at least the next two months. Many commentators, including famed advocate and researcher Erin Brokovich, have called it “the worst environmental disaster since the BP oil spill of 2010.”

The public health impacts of the leak have been tremendous so far. Methane is not only highly flammable, but can have serious health impacts. The NIH explains that methane exposure at high concentrations can cause headache, dizziness, weakness, vomiting, and loss of coordination. Though methane itself poses risks, the L.A. County Department of Public Health determined that mercaptans – nontoxic odorants added to natural gas – are to blame for current health effects. Residents have reported headaches and nosebleeds, which has forced the evacuation of over 2000 residents from their homes.

CBS reported that these relocated residents are part of a larger group of more than 6500 residents who have filed for help in the wake of the crisis. Though many are still in need of assistance and criticism of the company and the government is running high, activists in Porter Ranch have evaluated the incident from an environmental justice perspective and determined that they have been luckier than many. According to the LA Times, activists from the group Save Porter Ranch have noted that the wealth of their neighborhood has probably played into the relatively swift response and highly public discussion surrounding the leak, while poorer communities and communities of color are ignored. “There’s other communities with probably worse problems than us, for decades longer, that don’t get relocated,” activist Matt Palucko told the LA Times.

In addition to public health impacts effects, this disaster may have serious climate-related implications. Methane is a potent greenhouse gas; according to the EPA, methane’s impact on climate change is 25 times greater than carbon dioxide. The leak is estimated to be releasing nearly 70,000 pounds of methane on an hourly basis, and may end up accounting for about a quarter of California’s methane emissions for the year.

Though the source of the leak has been identified, Southern California Gas Co. has struggled to find a solution that would stem the flow of the methane. As soon as the leak was discovered, the company tried to plug the well, but several attempts were unsuccessful. They are opting to drill two ‘relief wells’ to divert the flow of gas, but this will be a lengthy and difficult process that may not be completed until March. In addition to the state of emergency, Gov. Brown also called for enhanced safety measure and inspections at gas storage facilities to prevent future incidents within the widespread and still-expanding natural gas industry.

Environmental Justice Concerns for Dominion’s ACP Pipeline

In the wake of the Paris agreements, alternative energy is first on the minds of many environmental activists. As we consider the impacts of fossil fuels on the environment, it’s critical to also recognize the environmental justice implications of our extractive energy industries. Across Virginia, opposition is growing in response to a proposed pipeline project that would carry natural gas across the center of the state. In addition to promoting natural gas drilling, the pipeline project carries a host of environmental and social justice concerns.

Dominion Power, under a subsidiary company,  is planning to construct an interstate pipeline for natural gas, dubbed the Atlantic Coast Pipeline. The pipeline would carry gas from West Virginia  to North Carolina, cutting a line across the middle of Virginia. Currently, the company is surveying land along the proposed route. In late October they submitted route changes to the Federal Energy Regulatory Commission, addressing concerns that were brought up with respect to the environmental impact statement on the project. Environmental groups, mobilizing together as the Allegheny-Blue Ridge Alliance, have opposed the pipeline given its potential to endanger water resources.
In addition to impacts to the natural environment, the pipeline project carries profound environmental justice implications. The project proposal involves placing a natural gas compressor station in Buckingham County near Charlottesville, VA, and community activists have raised concern that this compressor station, in addition to the pipeline itself, will mostly impact elderly African American residents. Friends of Buckingham County, a group opposing the pipeline, has been conducting surveys to better assess the demographics of the affected areas, and determine if historic African American communities in the area will be adversely impacted by the pipeline.

The environmental concerns associated with this pipeline are only a portion of what must be considered in the planning stages of this project. As the company’s survey work moves forward and environmental and EJ groups continue to mobilize against the plant, I will continue to follow this story, so stay tuned. Environmental Racism Prevalent in Brandywine, Maryland

Brandywine is  a town of less than 7,000 people located in Prince George’s County, Maryland.  The population in the county is 60% African American and they are all victims of environmental racism. Brandywine is a 21 square mile town is already home to one large gas-fired power plant. A few months ago, not one, but TWO additional gas fired power plants were  approved to be built in the town. The neighboring towns already have a gas-fired  power plant with another under construction. The area will have FIVE gas-fired power plants in the future,  making the Brandywine area have more fossil fuel power plant capacity than 99.9% of the country according to the Energy Justice Network.
 

The area already has unacceptable air quality and was declared by the EPA to be in “non-attainment” for ground level ozone pollution. According to the EPAs ozone health page, breathing ozone can cause a decrease in lung function, inflammation of the airways, and induction of respiratory symptoms such as coughing, throat irritation, pain and burning while breathing, and chest tightness, among others. It even states that ozone is associated with increased mortality. In some studies on lab animals, long-term exposure to ozone could cause “morphological changes that could be a market of chronic respiratory disease”. It is crazy to think that in an area where there are already non-attainable levels of ozone, that two more ozone producing power plants were approved to be built, especially with the clear information from the EPA about the dangers of ozone exposure.
Residents of the area are just learning of the power plants approval. Many of the local newspapers in the area shut down in recent years. When residents of the area found out about the proposed sites, they requested an extension on public comment to alert more people; they were given “tiny legal notice in a newspaper, which was inadequate to notify people of public hearings”. Since the sites have already been approved residents are having a hard time trying to fight back against the power plants. The surrounding communities in the Brandywine area are all victims of environmental racism and their rights are being violated with the construction of these gas-fired plants.

Study Finds Fracking Increases Reproductive Risks

The enormous growth of unconventional natural gas fracturing (also known as fracking) in recent years has come at the expense of knowing little if anything about the health risks associated with this practice. As production as slowed due to dropping gas prices in the past year or so, several studies have come out that raise serious questions about the health impact of this process. A study published earlier this month by a group of researchers at the John Hopkin’s School of Public Health concluded that “expectant mothers who live near active natural gas wells operated by the fracking industry in Pennsylvania are at an increased risk of giving birth prematurely and for having high risk pregnancies.” This paper was published in the journal Epidemiology.

In this paper, the authors examined more than 9,000 births in 40 counties in northern and central Pennsylvania between January 2009 and January 2013. They compared electronic birth outcome data with information that estimated the cumulative exposure to fracking activity in the region. This information included how close wells were to homes where the mothers lived, what stage of drilling the wells were in, the depth of the wells, and how much gas was generated from the well during the mother’s pregnancy. This information was used to generate a cumulative index of how active each of the wells were and how close they were to the women.

They found that living in the most active area of drilling and production activity was associated with a 40 percent increase in the likelihood of a woman giving birth before 37 weeks of gestation (considered pre-term) and a 30 percent increase in “high risk” pregnancies, a designation that can include elevated blood pressure and excessive weight gain during pregnancy. In total, 11 % of the pregnancies were born preterm, with 79% born between 32 and 36 weeks.

Other research in recent years has also shown a connection between fracking wells and low birth weight. “There are now four studies that have looked at various aspects of reproductive health in relation to this industry and all have found something,” Brian Schwartz, the lead author of the Hopkins study, said in an interview. In one of these studies, researchers found an increased risk of congenital heart and neural tube defects in babies whose mothers lived within 10 miles of a natural gas well in rural Colorado.

In a media statement released with the study, the authors made clear that the study can’t pinpoint the specific reason why pregnant women living near the most active wells had the worst pregnancy outcomes. But Schwartz pointed out that every step of the drilling process has an environmental impact. “When the well pads are created, diesel equipment is used to clear acres of land, transport equipment and drill the wells themselves. Drilling down thousands of feet and then horizontally many more thousands of feet requires heavy equipment to break up the shale where the gas sits. Hydraulic fracturing (fracking) then involves injecting millions of liters of water mixed with chemicals and sand to fracture the shale. The fluids are then pumped back to the surface. The gas itself also releases pollutants.” Schwartz also noted that living near fracking well results in increased noise, road traffic and other changes that can increase maternal stress levels.

“Now that we know this is happening we’d like to figure out why,” Schwartz says. “Is it air quality? Is it the stress? They’re the two leading candidates in our minds at this point.”

As with many other environmental and public health risks, the more we look, the more we find. We already know that fracking contributes to the impact of climate change because of the large amount of methane that’s released. It’s beginning to look more and more like it also has serious effects on the health of the people who live nearby.

New Study Highlights Reproductive Risks from Fracking Chemicals

Could pollution from unconventional oil and gas drilling cause reproductive problems? Scientists at the University of Missouri are trying to answer this question. A study published yesterday in the journal Environmental Health Perspectives assessed the research so far on endocrine disrupting compounds (EDCs) in chemicals used for hydraulic fracturing. The study presented research linking fracking to EDCs, and the authors recommended an increased focus on these compounds in assessing health risks from fracking pollution.

Endocrine disrupting compounds are a class of chemicals that can alter the delicately balanced endocrine system of the human body, interfering with processes involved in development and reproduction. Some EDCs prevent the endocrine system from carrying out normal functions, while others can mimic hormones naturally found in the body and cause increased endocrine activity. As the study authors note, EDCs are of particular concern because they can have effects at very low concentrations, especially during the early stages of development. Small doses of EDCs can cause drastic health changes, some of which can persist across generations.

One section of the study looked at the endocrine disrupting properties of individual chemicals in fracking fluid. Unfortunately, the identities of many of the approximately 1000 chemicals used in the fracking process are kept under wraps by industry, limiting the extent to which scientists can test any of the health effects they present. Of the chemicals the researchers were able to test, many had endocrine-disrupting properties. When the scientists assessed water samples from areas where drilling-related spills had occurred, they also found elevated endocrine disrupting activity. Chemicals involved in fracking processes are associated with reproductive effects, adverse pregnancy outcomes, and cancer, and several epidemiological studies cited in the paper found elevated risks for these problems in drilling-dense areas.

The study also focused on identifying gaps in our knowledge of EDCs in fracking chemicals. While our understanding of the impacts of individual chemicals is growing, we need to develop better methods for predicting and assessing how these chemicals might interact as part of a complex mixture, where the presence of multiple compounds could result in a more potent disruptive effect than that of one chemical alone. By studying concentrations of EDCs and their byproducts in people’s systems, we can determine what chemicals people are actually exposed to, and gather better information on whether these exposures are related to long-term health issues.

Overall, the study concluded that fracking health studies should include a significant focus on endocrine disrupting compounds. Among the many risks presented by fracking, exposure to complex mixtures of EDCs in the environment may prove to have extraordinary longterm effects.

The groups filing today’s notice letter are the Environmental Integrity Project, Natural Resources Defense Council, Earthworks, Responsible Drilling Alliance, San Juan Citizens Alliance, West Virginia Surface Owners Rights Organization, and the Center for Health, Environment and Justice. The groups are calling on EPA to comply with its long-overdue obligations to update waste disposal rules that should have been revised more than a quarter century ago.

“We’re asking that EPA finally do what it found to be necessary back in 1988:  update the regulations for oil and gas wastes,” said Adam Kron, attorney at the Environmental Integrity Project.  “The oil and gas industry has grown rapidly since then, and yet EPA has repeatedly shirked its duties for nearly three decades.  The public deserves better protection than this.”

For example, EPA should institute stricter controls for underground injection wells, which accept two billion gallons of oil and gas wastewater every day and have been linked to numerous earthquakes in Ohio, Oklahoma, and Texas. EPA should ban the practice of spreading fracking wastewater onto roads or fields, which allows toxic pollutants to run off and contaminate streams. And EPA should require landfills and ponds that receive drilling and fracking waste to be built with adequate liners and structural integrity to prevent spills and leaks into groundwater and streams.

“Oil and gas waste is extremely dangerous—yet the EPA admitted decades ago that federal rules are inadequate protect the public,” said Matthew McFeeley, attorney at NRDC.  “The scary truth is that right now this waste—complete with carcinogens and radioactive material—is being dumped irresponsibly or disposed of like everyday household garbage. Toxic waste should not be sent to run-of-the-mill landfills, sprayed on our roads and fields, or stored in open air pits.”

  • Across the Marcellus region: Over the past several years, landfills in states around the Marcellus shale formation—even in New York, where fracking is prohibited—have experienced increasing shipments of drill cuttings that contain high levels of radiation.  Many of the landfills do not test for radiation and do not have adequate controls to prevent the often toxic and radioactive “leachate” from seeping into groundwater.

EPA’s current regulations do not take into account the dangerous contents of oil and gas wastes or their unique handling and disposal practices.  Since 1988, the agency has acknowledged the shortcoming of its basic rules for solid waste management and has indicated that it needs to create enhanced rules tailored to the oil and gas industry. However, the agency has yet to take any action to develop these updated regulations.

“Improper handling of drilling waste threatens the health and safety of 3.5 million Pennsylvania residents whose drinking water comes from private wells,” said Barbara Jarmoska, who serves on the Board of Directors of the Responsible Drilling Alliance, a nonprofit advocacy group based in Lycoming County, Pa.  “It is past time for the EPA to put public and environmental health and safety first. EPA should revise existing regulations and specifically address issues relevant to the modern oil and gas industry.”

If EPA does not act within 60 days of today’s notice letter, the groups intend to ask a federal court to set strict deadlines for EPA to complete this long-needed update and strengthening of its regulations for oil and gas wastes.

“These are not your mom and pop wells of the 1980s, and their waste can no longer be ignored and listed as being non-hazardous,” said Teresa Mills, director of the Ohio field office for the Center for Health, Environment, and Justice.  “For the agency to continue to classify millions of gallons/tons of hazardous material as non-toxic is mind-boggling.  The free ride for the oil and gas industry must come to an end, now.”

Families Expose to Toxic Chemicals Lives’ Matter

I am so frustrated and cannot understand how to win equal protection of health for all people.  I’ve been doing this work for over thirty years and observed that unlike food contamination or infectious disease, where health agencies move at the speed of light to keep people safe, when the source is toxic chemicals from a corporation, people are sacrificed.  I’m looking for ideas from those who read this blog.  Just recently we saw the call to action to protect public health  around the cilantro scare.

This week I received requests for help from local leaders CHEJ is working with that related to health studies and public health impacts from chemicals in their environment.

One study around hydro fracking, researchers found that pregnant women living near clusters of fracked wells were more likely to have babies with lower birth weights.  The second study found higher rates of hospitalization for heart conditions, neurological illness, and other conditions among people who live near fracking sites.

Those studies were not enough to stop fracking in the communities. In fact, health authorities said they believe it may not be the fracking at all – it could just be a random clustering of medical problems.

The third study was around a low wealth African American community in Birmingham, Alabama. Adjacent to the community is Walter Coke Facility that manufactures coke, toluene sulfonyl acid, produces pig iron from iron ore and more.

The Federal Agency for Toxic Substance and Disease Registry (ATSDR) conducted a study to determine the health risk to community families based upon exposures to arsenic, lead, and polycyclic aromatic hydrocarbons (PAHs) found in residential surface soil and homegrown garden produce in the communities collected from November 2012 through January 2015.

ATSDR concluded that:

  • past and current exposure to arsenic found in surface soil of some residential yards could harm people’s health. Children are especially at risk.
  • past and current exposure to lead found in surface soil of some residential yards could harm people’s health. Swallowing this lead‐contaminated soil could cause harmful health effects, especially in children and in the developing fetus of pregnant women.
  • long‐term exposure (i.e., many years) to PAHs found in the surface soil of some residential yards is at a level of concern for lifetime cancer risk.

The agency’s recommendation was for parents to:

  • monitor their children’s behavior while playing outdoors and prevent their children from intentionally or inadvertently eating soil;
  • take measures to reduce exposures to residential soil and to protect themselves, their families, and visitors;
  • have their children tested for blood lead; and
  • for EPA to continue testing for arsenic and lead in the soil and continue with its plans to cleanup additional properties (patch quilt of clean up not community wide as though the wind won’t carry toxic dust from one yard to another) to reduce levels in residential surface soil.

There was no mention of what the polluter should do. No mention of relocating families from the area to safe housing somewhere else. There was no mention of health monitoring or a clinic for people, especially children who are exposed and sick.

What level of human tragedy, suffering and loss of life will it take to stop the poisoning of American people from toxic chemicals?  The ethics behind the two responses of food/infectious disease versus chemical threats to public health is unethical.  Families being exposed to toxic chemicals matter just as much as everyone else. It’s time our health agencies stopped treating them as sacrificial families to protect corporate profits.

We Are Together & Together We’ll Make Change

As fracking bans and moratoriums or local ordinances become a reality across the country, it would be so powerful for those who are advocating change to one piece of the problem or solution, to include the other parts of the gas and oil industry’s problems, processes, etc. as well. Working together on alternatives, disposal, rights to know, exports and more will provide the holistic approach to the public. That can really make a bigger – deeper difference in how people respond to efforts that go beyond a backyard struggle towards a sustainable communities. It might even bring clarity to the public that is getting so many different messages and become confused.

At CHEJ we just celebrated the next step toward a ban in New York on fracking, but Obama is still pushing regulations. We’ve seen pipelines stopped, at least temporarily and ordinances passed. Most recently two counties in Ohio have passed local moratoriums on injection wells that will force the industry to find other ways to dispose of their wastes. Two other Ohio counties are in the mist of deciding to ban injection wells that activist say have a good chance of passing.

It appears from the “wide view” that our staff and Board can see as a national group, as we look across the country that there are serious efforts and real wins by ordinary people. What isn’t as obvious is a strong message that we are together and supporting other groups who have taken on different parts of the problems, are encouraged and inspired by the wins and share the vision of what could be. It’s not that people aren’t mentioning other segments of the struggle locally or at a higher level of government, but it’s not coming through as a unified struggle for a unified goal. No there will never be absolute agreement on goals but maybe we could get agreement on a unified message that works. At CHEJ we came up with Preventing Fracking Harms to address the different goals around wells, infrastructure and such. That won’t work in the bigger message but I think there are words that might.

As groups join together this fall at events like the one planned for October in Colorado it would be great to find an opportunity on or off the agenda to figure out how all the extraordinary work folks are doing can include a message – not a list serve – not a petition – but a message that gets tagged on everyone’s everything before they close their news release, blog, signs and more. Or maybe we have a massive e-mail conversation. Let me know what you think.

Congratulations New York! The New York State Department of Environmental Conservation (DEC) issued their Findings Statement on June 29, 2015, bringing their seven-year review of fracking to an end. This is big news because the state sits on 12 million acres of Marcellus shale. This formation of rock has natural gas reserves that have put states such as Pennsylvania and West Virginia on the energy production map. New York is the first state with significant potential to produce major natural-gas resources that has banned fracking.



It wasn’t easy for New York to achieve this ban. Although there are many known and unknown health effects of fracking, the industry yields high profits which allows some people to see a pay raise instead of the threat that stands before them. Energy companies and some local communities fought the ban. Some NY towns even threatened secession. Many people in those communities were hoping to lease their land to energy companies and reap the economic benefits. Some states are even banning fracking bans. In May, both Oklahoma and Texas signed bills that prohibit towns from banning oil and gas operations. According to the National Law Review, Oklahoma’s ban was signed even amid “warning from the state’s own government that a recent dramatic spike in earthquakes is linked to wastewater injection”, which is a main process of fracking. Against all the odds, New York won the right to protect their communities from the aftermath of fracking.

The state of New York reviewed the process and health repercussions of fracking for seven years. New York DEC commissioner Joe Marten said based on the Findings Statement, “prohibiting high-volume hydraulic fracturing is the only reasonable alternative. High-volume hydraulic fracturing poses significant adverse impacts to land, air, water, natural resources and potential significant public health impacts that cannot be adequately mitigated. This decision is consistent with DEC’s mission to conserve, improve and protect our state’s natural resources, and to enhance the health, safety and welfare of the people of the state.”

The DEC’s Findings statement is based on a lengthy report about the fracking process that began in 2009. The DEC has been working on the statement since December 2014, when Marten stated that too little was known about the health impacts of fracking to support the ban. The statement concluded that there are no alternatives to the environmental and health risks that fracking causes. Because of this, New York joins Vermont in outlawing the risky practice.

Opponents of the ban are expected to file lawsuits, and although the fracking ban can be rescinded, Earthjustice, the attorneys representing the case, guarantee “to stand alongside the state in any legal challenge”. This is a big win for both the state of New York and the environmental justice community as a whole.
