Wilmington Demands Clean Water, Clean EPA

Don’t drink the water. That’s something you’d expect to hear when you travel to a developing country. But that’s what people are saying in Wilmington, a historic beach, tourist and retiree destination and the eighth-largest city in this state. It also happens to be one of my favorite places to go when I need a reprieve from the heat and humidity of central North Carolina. With its charming historic riverfront, shops, delicious restaurants, parks, water sports and beautiful beaches, it’s a great place to relax and unwind. The last thing one should have to worry about is the safety of the local drinking water.
Over the past couple of months, Wilmington residents have learned that DuPont and its spinoff company Chemours have been dumping unregulated chemicals into the Cape Fear River for decades and only recently stopped at the request of the governor. The result: Disturbing levels of chemicals like 1,4-dioxane, GenX and PFOA have been found in the drinking water of residents in Wilmington, Brunswick and the surrounding area.
These types of of chemicals, called fluorinated compounds, have been linked to cancer, thyroid disease and obesity. GenX and other fluorinated compounds are used in the making of Teflon, Scotchgard and other stain-resistant and water-repellant products. They are designed so that they are water- and oil-repellant, which means that they are extremely difficult to treat in water-treatment plants before they hit our taps.
While GenX has received a lot of the attention, the chemical 1,4-dioxane – which is much more well-studied – has been found in some places to be in excess of 35 parts per billion, a level at which, when consumed regularly over the course of a lifetime, cancer risk becomes two orders of magnitude higher than that at generally acceptable levels. Many Wilmington residents have been drinking this water their whole lives. Now they must worry about the risks to their and their children’s health.
Wilmington has asked the EPA to start looking into GenX and investigating the safety of its water. But with asbestos denier Scott Pruitt and chemical industry representative Nancy Beck overseeing EPA’s program in charge of regulating these chemicals, I don’t have much faith in their investigation. Now, the Trump Administration has nominated Michael Dourson to lead the entire toxics program at the EPA. Will Mr. Dourson provide hope for Wilmington?
A look at his background also leaves me skeptical. In 2002, DuPont hand-picked Dourson’s firm Toxicology Excellence for Risk Assessment (TERA) to advise West Virginia’s Department of Environmental Quality on setting health levels for PFOA, one of the same chemicals now found in Wilmington’s water. His firm came up with a level that was thousands of times less protective than a later EPA assessment. 1,4-dioxane is currently under review by the very office that Mr. Dourson has been nominated to lead. Yet he also published research on that chemical paid for entirely by PPG, a company responsible for discharging this chemical and contaminating Ohio’s waterways.
Saturday, I went to a Rally for Clean Water in Wilmington to talk with residents about their concerns. They want what we all want – to know that when they open up the tap, they can drink the water without worrying about toxic chemicals. And they deserve better: corporate polluters that are held accountable for egregious pollution and government officials who will protect their health and safety at the local and the national level.

Increases in Infant Mortality Linked to Fracking

A new study published last week in the Journal of Environmental Protection provides new evidence that the gas extraction process of hydrofracturing, known as fracking, is harming the health of people who live near these wells. This study found that counties in Pennsylvania with higher numbers of fracking wells had higher rates of infant mortality.

The authors compared early infant mortality for the years 2007-2010 in ten Pennsylvania counties that were heavily fracked to the rates for the rest of the Pennsylvania (excluding the 10 heavily fracked counties) for the years 2003-2006 which was considered a pre-fracking period. The results showed a statistically significant 29% excess risk for newborn infants of dying during the first 28 days of life if they were born in the ten heavily fracked counties during the 4-year period following development of fracking gas wells in these counties. The early infant mortality rate for the rest of the state decreased by 2% during this same time-period. The association with infant mortality was even greater in the five northeast Pennsylvania counties of Susquehanna, Bradford, Wyoming, Lycoming and Tioga where the early infant mortality rate increased by 67%. These counties had the greatest number of fracking wells. The early infant mortality rate was increased by 18% in the five southwest Pennsylvania counties of Washington, Westmoreland, Greene, Butler and Fayette where fracking also occurred but at lesser rates.

According to the report, about 50 more babies died in these 10 counties than would have been predicted if the rate had been the same over the study period as it was for all of Pennsylvania, where the incidence rate fell over the same period. Although the study could not prove what might be causing these increases in infant mortality, the authors did observe an association between early infant mortality and the number of drinking water violations in private wells in the five northeast PA counties. This finding led the authors to state that the increase risk of early infant mortality might be related to exposure to drinking water which may be contaminated. They further noted that this contamination might be due to the release of naturally occurring radioactive material, including radium, thorium and uranium caused by underground explosions set off by the natural gas extraction process.

In closing, the authors described early infant mortality as “a flag for genetic damage, and thus represents a “miner’s canary” for other ill health effects in children and adults, particularly cancer, though there is a temporal lag in cancer between exposure and clinical expression.” While this study has its limitations, it still raises serious questions about the safety of the natural gas extraction process called fracking. Native Nations Rise March: A Powerful Uprising for Indigenous Rights

Indigenous people from around the world gathered to promote sovereignty, resistance, respect, justice and love at the Native Nations Rise March 10th. I was honored to walk along side of Indigenous women, children and men.  The weather was freezing with rain, sleet and snow. The wind howled as if joining the marches with a powerful message of protecting the earth and halting the harms.
The march began at the United States Army Corps of Engineers building and then moved past the Trump International Hotel. In front of the Trump Hotel a short demonstration was held to let guests and Trump hear the voices of the people. Now completely frozen, I continued to march to the White House.  Throughout the march there was a unified message aimed at President Donald Trump and his administration: Mni Wiconi, “Water is Life!” The chant has become a shorthand for tribes’ struggle to reassert tribal sovereignty and self-determination over their physical and spiritual spheres. The phrase was joined by many other expressions aimed at attracting the attention of the federal government: “We stand with Standing Rock!” – “Keep the oil in the soil, you can’t drink oil!” – “Hey, hey! Ho, ho! Donald Trump has got to go!” – And, “Shame, shame, shame!”
A rally with extraordinary speakers joined at the end of the March at a park, in front of the White House. Powerful words were voiced by Native leaders. It was a march that I will always hold close to my heart. Although I was frozen to the bone – I felt fire in the belly and ready to take on the fight for justice.

Fracking Linked to 9,442 Official Complaints in Rural Pennsylvania

Between 2013–2016, Public Herald conducted 50 file reviews at DEP‘s offices and tracked down 6,819 complaint cases files. On December 30, 2016, DEP gave Public Herald an updated spreadsheet showing that 9,442 complaints have been filed between 2004–2016 and thousands of these center around water contamination complaints. What Does Standing Rock and Love Canal Struggles Have In Common?

Real democracy in action.  Both situations did not have the law on their side, regulations or much of anything. Yet both of those fights had real victories. There are real lessons that can be learned from these two high profile situations. Lessons that are important as we as a country enter the Trump era. Although there was science and legal work in both situations that was done to build a case to stop the madness that was not the magic answer.  It was people. Hundreds of people and at time thousands of people who stood up, took risks, spoke out in a united voice to say, “NO” that made the difference.
It was also using the media and a narrative that the average American person could understand.  It was value-based and widely supported. One of the differences was at Love Canal the residents had the mainstream media on their side. In Standing Rock it was the alternative media, Amy Goodman from Democracy Now, who refused to let the story go. It wasn’t until she was charged by police for breaking the law, that the story caught on with the mainstream media. There was also the difference of Love Canal families who were largely working class white people and at Standing Rock were Indigenous Peoples at the center of the struggle. That’s part of America’s racism that is real and again demonstrated at Standing Rock.
This is a story,  a comparison which needs more analysis and lessons learned. Yes, a longer article needs to be written. Unfortunately I can’t do that now, but  will likely in the future. My reason for raising this comparison at all, is for all of those who say under Trump we have no chance. Yes you do–yes we do– but only if we organize people, unite voices and build the political power that is needed to not only save what we’ve got, but win more. We can do it– but it takes stepping out of your place of comfort, take some risks like signing a petition that your friends might not agree with or giving something– a dollar, an hour, food, make a phone call, go to a meeting  and so much more. Today is the day for you to make a change so we — all of us — can live in a free, safe, healthy  and inclusive world.

Drinking Water –Topped the List of Calls for Assistance

Fortunately CHEJ was able to help community after community with questions and concerns about their water. Moms, dads and individuals panicked ask for help – what can we do to protect our children – ourselves?
CHEJ scientists were there to answer questions about toxicity, safe levels and health impacts from exposure.  We were there to help because you were there — providing the resources through contributions large and small. Thank you for making sure we were able to respond to the many people who needed advice from a trusted person.
Here’s a few of their introductory sentences.

Unfortunately, the issue around safe drinking water are not going away any day soon. In fact some believe the trend toward unsafe water is more likely to continue. Why? Not because there is more pollution that will contaminated the water, although there might likely be more. It’s because people are now demanding that schools, day care facilities and water suppliers provide a yearly test that includes lead, copper and other contaminates. Parents and teachers are asking that all child related facilities test yearly and share the results of the water samples with parents, staff and school boards immediately.
This testing is not routine and when it is done the results are rarely shared with the public. Therefore, places where children have been exposed for years, will surface and concerned people will be looking for trusted advice.

Is Your Drinking Water Safe?

Corpus Christi, Texas, residents warned to avoid tap water.
Residents of Corpus Christi, Texas were told to not to drink or bathe in the tap water because of a chemical contamination. About 300,000 people in Corpus Christi on the Gulf of Mexico coast were impacted by this crisis. Residents were told that nothing including boiling, filtering, adding chlorine or other disinfectants, or letting the water stand will not make the water safe.
The contaminants have not yet been named, but are petroleum-based from an asphalt plant. The contamination was the result of a faulty valve in the city’s industrial area, which caused a back-flow leaking toxic contaminates into the drinking water supply.
In cities with industrial areas it is important to ask if your city has safeguards in place to prevent this type of accident from happening to your public water supply. Although the problem was unidentified and is being corrected there were 300,000 people who are potential victims of toxic exposures that can cause all types of medical problems including cancers, reproductive, nervous system and more.
An ounce of prevention is worth a pound of cure.

The New Lead – Perfluorinated Compounds (PFCs)

It’s bad enough that lead is making headlines everywhere, but now a new group of chemicals is showing up in drinking water across the country – in Portsmouth, NH, Hoosick falls, NY, Scottsdale, AZ, Colorado Springs, CO, Decatur, AL, Bucks County, PA, Cape Cod, MA to name a few places. These chemicals are called perfluorinated compounds, or PFCs and they first generated headlines in the 1990s when they contaminated the drinking water for 70,000 people of Parkersburg, WV where a DuPont plant made teflon and related products for decades. Exposure to these chemicals is linked to developmental delays in children, decreased fertility, increased cholesterol, changes in the immune system, and cancer (prostate, kidney and testicular).
PFCs are quickly becoming the “hot” chemical to look for in drinking water as it seems to be showing up everywhere including places such as the Pease International Tradeport Business and Industrial Center in Portsmouth, NH. In the summer of 2014, the City of Portsmouth reported that two unusual chemicals were found in all three wells that serve the business center as well as the NH Air National Guard Base on the site of the old Pease Air Force Base. The concentration of one of these chemicals – perfluorooctanesulfonic acid (PFOS) – exceeded the USEPA Provisional Health Advisory (PHA) causing the city to immediately shut down the well. PFOS and perfluorooctanoic acid (PFOA) are part of the class of chemicals known as perfluorinated compounds, and they are starting to show up in drinking water wells throughout the country.
PFCs are common in many consumer products, including teflon pans, fabric protectors, pizza boxes and ski wax and it is used to make carpets, clothing, fabrics for furniture. They are also used to fight fires and in a number of industrial processes. At the Pease Air Force Base in Portsmouth, the water became contaminated when firefighters practiced putting out fires on abandoned portions of the airbase using firefighting foams that contained PFCs.
PFOA and PFOS contamination in drinking water is thought to stem from two main sources: factories that formerly manufactured or used the chemicals, and locations, including military bases, where they were used in firefighting foams. According to the EPA, both PFOA and PFOS are found at very low levels in the blood of the general population across the U.S.
Although no one lives at the Tradeport Center, more than 10,000 people work there and there are two day care centers. The people who use the daycare centers immediately formed a Facebook page called “Testing for Pease” and began asking for blood testing for the children. Soon more than 500 adults and children had their blood tested for PFCs and many had levels that were higher than the general population. More blood testing is now underway as the community struggles to make sense of the results and what it means for their future. The health effects of PFCs are not well understood but studies in communities with similar exposures found associations with kidney cancer and testicular cancer. Other concerns includes high cholesterol, immune damage and possible reproductive effects.
In May of this year, the EPA finalized its Health Advisory for PFOA and PFOS lowing its advisory value from 400 and 200 respectively to 70 parts per trillion (ppt) for both compounds combined. This level was based on a lifetime exposure to total PFCs. This change followed criticism from researchers at the Harvard University School of Public Health that the original PHA was not adequately protective of the public.  This health advisory is based on long term exposure to PFOA and PFOS in drinking water.

What if government knew your water was toxic in 2008 and told you in 2016?

I’d be outraged. This is a real life situation. It took eight years for water results to be analyzed and reviewed by the federal public health agency for a small Pennsylvania community. They concluded that drinking water was not safe to drink; and that the agency has no information about water contaminates from 2011 through 2016.
Is it safe now?  Although samples were taken over the eight-year period, no one knows. The federal health scientists have never seen those results. Even if they did, it might take another eight years to get the results — that would be 2024.
This is terrible . . . right?  Unfortunately, it actually gets worse. The state health scientists said that same water was safe to drink, as did the federal Environmental Protection Agency (EPA) after reviewing the same sample results.  . . . yet the water was poisoned. It is unknown how many people mixed baby formula or bathed their young children in this toxic water.
I looked into why now, in May, 2016, did the federal Agency on Toxic Substance Disease Registry (ATSDR) release a report concluding the water was unsafe to drink. I found a recent news story that announced that the victim’s lawsuit against the polluter was recently settled in court. This settlement, in Dimock, Pennsylvania against Cabot Oil & Gas was the only change in the situation.  Although I could be wrong, my conclusion was that the agency decided not to get involved in the messy trial of a multinational corporation. Instead, allowed a community to be poisoned. If that’s true, then I have no confidence nor hope that the American people are protected by their own public health government agency. In fact, it reaffirms for me that our public health protections are controlled by polluters and their lawyers.
Families, young children, and women of childbearing age drank toxic water with false assurances of safety from the very agencies charged to protect them. What is the public supposed to do? Whom can they trust?  Why can’t our health authorities act in the best interest of public health of the American people who pay for their services through our tax dollars?
For the past thirty five years, I’ve watched the criteria for health assessments go from the preponderance of evidence (collection of all relevant studies, their quality, sources and conclusions) to obscure abstract mathematical assessments.  In the past five years, it’s gotten worse. When results are undeniably harmful to public health, even using this abstract model, the results are held from the public, with agencies utilizing “draft” as reasons for not releasing reports to the public. All this time, health professionals know people are being exposed to unnecessary, and in some cases, avoidable health risks. You need not look any further than what is still happening in Flint, Michigan with their drinking water to understand this problem.
The jury’s verdict on water contamination in Dimock may have broad implications for the broader debate about the environmental risks of the shale drilling rush nationwide. Although the case did not center on claims that the fracking process (as opposed to drilling, well casing failures, spills or other problems) had directly caused the water contamination, most of the gas wells that the plaintiffs focused their attention on were aimed at the Marcellus shale gas formation.
Kassie Siegel, director of the Center for Biological Diversity’s Climate Law Institute, commented, “This is a huge victory for the people of Dimock, but it’s also a sharp rebuke to the Obama administration for failing to fully investigate threats posed by fracking and dangerous drilling to water supplies in Pennsylvania and across the country. Because of the EPA’s disturbing history of delay and denial, it took a federal jury to set the record straight about the natural gas industry’s toxic threat to our water.”

Did you hear that the Flint water crisis is over?

Did you hear that the Flint water crisis is over?  Nothing could be further from the truth. President Obama’s attempt to prove the water’s safety by drinking it on national television left many Flint residents confused and angry.  Right now, pregnant women and children under age six are still being warned not to drink the water.  How safe is it? Many Flint residents are relying on bottled water to bathe, cook, and brush teeth.  Flint’s old leaded pipes are a long way from being replaced.  The chemicals being used to seal pipes are showing problems. Flint’s residents are rightly anxious about the safety of the water.
 
The early signs which concerned moms and dads noticed included hair loss, sudden skin rashes, abdominal pain.  They knew something was wrong, but for many parents, learning that the child was lead poisoned was much worse than anything else they had imagined.  The heartbreak continued as they found that their kids were now at high risk for ADHD, low IQ, among other long-term health effects. Here is one mother’s story:
 
‘I’m not taking a bath . . . it hurts my skin.’ The evening struggle begins again for a mom whose child refuses to bathe. The contaminated water was causing her young son’s rash. ‘I took him to the doctors. I was told to keep his skin clean and to bathe him every night. The doctor said he had contact dermatitis from something like laundry soap, bar soap, or something else he comes in contact with. I never thought water from my faucet could be hurting my baby.”  
 
Oversight responsibility over city water is the local government’s job. Local government is required to report to the state, which is overseen by the federal EPA water division.  One breakdown in oversight is bad, but a break down at every level means somebody or everybody is slacking on the job and does not care.  
 
Sasha Khokha, a journalist from California National Public Radio has a different distressing story.  After she heard about the water crisis in Flint, she decided to check her tap water. When she reviewed her water bill from the city of Fresno, she read the “consumer confidence report” for drinking water.  Sasha read the footnote in small print: ‘123 Trichloropropane (1,2,3 TCP) has been detected in 29 wells in Fresno…. Some people who use water containing it over many years may have an increased risk of getting cancer, based on studies in laboratory animals.’
 
Fearing for her two children, she decided to get her water tested for the presence of chemicals.  The sample from Sasha’s kitchen tap showed 2.2 parts per trillion, three times the state’s public health goal for 1,2,3-TCP.   Twenty-five years after California declared 1,2,3-TCP to be a carcinogen, drinking water regulators are only now planning to set a standard for drinking water.
 
And it’s not just Fresno. According to the State Water Resources Control Board, the chemical has been found in about a hundred public water systems across California, mostly in the Central Valley, but also in counties like Santa Cruz, Monterey, Sacramento, and Los Angeles.  
 
We have do better as a country, every person deserves safe drinking water – it is a human right.
