Formaldehyde: A Case Study in EPA’s Failure to Protect Public Health and the Environment

According to its website, the mission of the Environmental Protection Agency is to “protect public health and the environment.” When the agency tries to do its job, it often runs into opposition led by special interests, private lobbyists, corporate apologists, and congressional representatives, all of whom have their own agenda, which has nothing to do with public health or the environment and everything to do with the millions (if not billions) of dollars made annually from their products.

The agency’s effort to regulate formaldehyde, a known human carcinogen that is commonly used in building materials found in most homes, is a classic case study in corporate influence and control of the agency’s work.

EPA began its process to regulate formaldehyde in compressed wood products in 2008, seven years ago. Its proposed rules, released for public comment on June, 2013, did not seek to ban formaldehyde, but rather to set exposure limits and establish testing standards for products sold in the U.S. Learn more about the EPA’s proposed rules for formaldehyde emissions from composite wood products.

Three times over the next two years, EPA reopened its public comment period to allow more public comment, most recently in May 2014. EPA has yet to release its final regulations with the latest timeline estimated to be sometime in the fall.

A story in the New York Times chronicled the delays in the agency’s efforts to regulate formaldehyde, a substance with clear public health risks. The article described the influence of the big furniture companies on Washington who in turn pressured EPA. It told of the actions of special interest such as the American Chemistry Council who challenged the agency’s determination that formaldehyde is a carcinogen. And it described the role of the White House Office of Management and Budget in evaluating the costs and benefits of the proposed regulation.

What gets lost in the hyperbole and grandstanding over costs and jobs is the fact that formaldehyde is a nasty chemical that is a known human carcinogen, that affects the central nervous system and that can damage the respiratory system, causing difficulty in breathing including asthma as well as eye, nose, and throat irritation. At best this proposed regulation will attempt to define an “acceptable” level of formaldehyde vapors coming off pressed-wood products, such as particleboard, plywood, and fiberboard; glues and adhesives; permanent-press fabrics; paper product coatings; and certain insulation materials.

This is EPA’s version of protecting public health and the environment, agreeing with corporate interests after a tortured “public” process to a risk assessment that defines “acceptable” levels of risk that the public has to endure while the companies continue to earn their profits. The general public that has to live with formaldehyde fumes coming off wood products is not likely to see it this way. They might prefer that the agency try to figure out how much risk it can avoid, rather than how much is “acceptable.” But then if the EPA did that, then the influence imposed by the companies who make billions every year selling formaldehyde products might not be so critical.

Missouri Mothers Ask For Relief this Mother’s Day

Community moms with sick children traveled from Bridgeton, MO to Washington D.C. to demand action from EPA Administrator Gina McCarthy and Philanthropist Bill Gates – to use their power to save innocent families living adjacent to Republic Service’s Superfund landfill in St. Louis, MO that is burning out-of-control and contains radioactive wastes from the Manhattan Project.


Republic’s landfill has been burning due to an underground fire that has been spewing toxins for years – leaving nearby families physically harmed and financially trapped. The state of Missouri found that the community has a childhood cancer cluster, a high number of rare appendix cancers, and many other diseases which local families believe are directly related to the fire and radioactive wastes.


The U.S. Environmental Protection Agency has the authority to protect and move families under the Superfund program. Bill Gates has the power to protect and move families using his voting power as the dominant shareholder of Republic Services. Donald Slager, Republic Services CEO, is the owner of the site has a moral responsibility.


“It is outrageous that EPA Administrator McCarthy is allowing this poisoning of American families to continue.  McCarthy has mismanaged this site for years. Additionally, she relocated (or “transferred” –  what the EPA does instead of firing) everyone – including EPA’s regional administrator Karl Brooks – while innocent people are trapped living in fear. The state of Missouri admitted that the fire will never be put out and it will be more than two years before the first shovel of dirt is moved to build a barrier wall between the fire and radioactive waste. This is unacceptable. EPA has the authority to move families away from the danger through Superfund. McCarthy must use her authority to protect innocent American families,” said Lois Gibbs, Executive Director of the Center for Health, Environment and Justice.


“My child is suffering with an autoimmune disease called alopecia and from asthma. Besides that, our community has a childhood cancer cluster – so I go to bed at night worried that my son will also develop cancer. I think if Administrator Gina McCarthy heard our story, she’d agree to move our families now,” said Meagan Beckermann, a resident and member of the community group Just Moms STL.


Dawn Chapman, another mom and Just Moms STL member who flew to DC from St. Louis, hoping for a meeting with McCarthy, said, “We are living next to an out-of-control burning Superfund site that just had a 500% increase in sulfur emissions over the past year alone.”


“Property values are declining in communities surrounding the site. We are imprisoned in our homes that we cannot morally sell with good conscience,” said Karen Nickel, another member of Just Moms STL.


A group representing Just Moms STL marched to EPA headquarters today to deliver a letter to Administrator McCarthy and hand out flyers asking those passing by to contact the Administrator’s office and urge her to meet with the victims of the out-of-control fire and radioactive dumpsite.


The group of protesters then marched to the Bill and Melinda Gates Foundation in D.C. to deliver over 1,500 signatures on a petition to ask Bill Gates to use his voice and power as the dominant shareholder in Republic Services to ask the corporation to stop the suffering, and to purchase the homes of victims who need to be moved away from the toxic landfill.

Linking Adverse Health Effects and Chemical Exposures

One of the most common questions I get asked is about the health effects of toxic chemicals. Will the chemicals in the landfill harm my children? Will the emissions from the plant cause my family to get cancer? Did the chemicals off-gassing from the PVC flooring cause my son’s asthma? The questions continue every day from people across the country.

Most of what we know about the toxicity of chemicals comes from animal studies and from studies of workers who manufacture the chemicals. From this experience, we’ve learned that dusty air causes lung cancer, benzene causes leukemia, radioactive paint causes bone cancer, vinyl chloride, liver cancer, and certain pesticides cause muscle weakness and paralysis. There’s also limited evidence from studies in communities, especially among children who are highly susceptible to toxic chemicals. At Love Canal, for example, there were high rates of miscarriages and children born with birth defects; in Tucson, AZ, children whose parents drank water contaminated with trichloroethylene (TCE) were born with 2-1/2 times more heart defects than normal; in Toms River, NJ, high rates of childhood cancer was linked to drinking water contaminated with TCE and other solvents; and in Woburn, MA, increased rates of childhood leukemia were associated with drinking contaminated water.

There is no question that exposure to toxic chemicals causes adverse health effects. But for nearly all chemicals there is not enough information on what happens when people are exposed. At best, there’s good information on the toxicity of only about 10% of over 80,000 chemicals in use today.

This makes it very difficult to say with certainty what health effects will occur following exposure to toxic chemicals. Among the uncertainties are how an individual body responds to exposure (this varies quite a lot from person to person), how long exposures occur, how many chemicals you’re exposed to and the actual toxicity of the substance. In most instances, these factors are unknown.

Another confounding factor is that many symptoms or diseases are not specific to a particular chemical. In most instances, there can be many causes of the symptoms that people are having. And since few physicians know much about toxic chemicals, they often tend to blame the victim for his or her situation rather than looking at chemicals as a possible explanation. For example, many physicians will diagnose a person who is fatigued, moody and without appetite as “depressed,” likely to have a problem at home or at work. Seldom is exposure to toxic chemicals considered, even when raised by the patient.

Still another problem is determining the “normal” rate of an illness or disease in a community or in a group of people. Scientists simply can’t decide amongst themselves what is normal, in large part because of the many uncertainties already mentioned.

As a result, evaluating chemical exposures is largely a matter of opinion, not fact. Scientists can give you estimates of risk, or tell you what adverse effects are typically associated with exposure to a chemical, but they cannot tell you with any certainty whether your child will develop cancer because of his/her exposure to TCE or other chemicals in your drinking water. They can give you their opinion, but it’s only an opinion.

This is very frustrating for people. How can we be smart enough to put a man on the moon and bring him back, yet we don’t know much about the toxicity of the sea of chemicals that we live in every day? This speaks volumes about the power of the chemical industry to control government regulations and research agendas.

EPA’s EJ 2020 Action Agenda

The U.S. Environmental Protection Agency has released a draft for public comment of its EJ 2020 Action Agenda (EJ 2020) Framework. This strategy document lays out its plan for continuing to address environmental justice in the context of the agency’s work. EPA is hoping to build on its EJ 2014 Action Agenda and expand that work through commitments that will continue over the next five years. EPA is seeking input on the draft EJ 2020 Action Agenda framework. The public comment period runs from April 15 to June 15. The agency is planning to conduct informational and dialogue sessions during this comment period and is encouraging the public to submit written comments. As described in the draft framework document, “EPA’s environmental justice efforts seek to protect the health and environment of overburdened communities, support them to take action to improve their own health and environment, and build partnerships to achieve community health and sustainability.”

The agencies goal through 2020 is to make a visible difference in overburdened communities by:

  • Deepening  environmental justice practice within EPA programs to improve the health and environment of overburdened communities;
  • Collaborating with partners to expand our impact within overburdened communities; and
  • Demonstrating progress on outcomes that matter to overburdened communities

Key elements to the EJ 2020 plan include incorporating EJ in rulemaking; considering EJ in permitting; advancing EJ through compliance and enforcement; supporting community based programs; fostering administration-wide action; and developing science and legal tools for considering environmental justice in decision-making. The framework document also includes a chart that defines the agency’s status and progress in achieving these key elements. In addition, EPA has established a one-stop informational “Resource for Communities” web portal as well as a new EJSCREEN tool that quantitatively identifies areas with potential EJ concerns by using environmental, health, demographic and enforcement indicators.

Chemical Exposures and Health Care Costs

A new economic analysis has concluded that exposure to endocrine-disrupting chemicals likely costs the European Union €157 billion ($209 billion U.S.) a year in actual health care expenses and lost earning potential, according to a new series of studies published in the Endocrine Society’s Journal of Clinical Endocrinology and Metabolism.

A total of four papers were published (overview, neurobehavioralmale reproduction and obesity & diabetes) that focused on specific health conditions that can partly be attributed to endocrine-disrupting chemical (EDC) exposure. These included infertility and male reproductive dysfunction, birth defects, obesity, diabetes, cardiovascular disease and neurobehavioural and learning disorders. A team of eighteen researchers from eight countries led by Leonardo Trasande, Associate Professor of Pediatrics, Environmental Medicine & Population Health at NYU Medical Center, were involved in this landmark initiative.

EDCs interfere with numerous hormone functions and are commonly found in thousands of household products including plastics made with vinyl, electronics, pesticides, and cosmetics.

The overview paper concluded that “EDC exposures in the EU are likely to contribute substantially to disease and dysfunction across the life course with costs in the hundreds of billions per year. These estimates represent only those EDCs with the highest probability of causation; a broader analysis would have produced greater estimates of burden of disease and costs.”

The papers were prepared in conjunction with an evaluation being done by the EU Commission of the economic impact to industry of regulating EDCs in Europe. According to the authors, “Our goal here is to estimate the health and economic benefit of regulating EDCs in Europe, based on current evidence.”

The expert panels put together for this analysis “achieved consensus for probable (20%) EDC causation for IQ loss and associated intellectual disability, autism, attention-deficit hyperactivity disorder, childhood obesity, adult obesity, adult diabetes, cryptorchidism, male infertility, and mortality associated with reduced T.”

“The analysis demonstrates just how staggering the cost of widespread endocrine-disrupting chemical exposure is to society,” said Leonardo Trasande, the lead author in a press statement released by the Endocrine Society. “This research crystalizes more than three decades of lab and population-based studies of endocrine-disrupting chemicals in the EU.”

The press release goes on to say:

In the EU, researchers found the biggest cost driver was loss of IQ and intellectual disabilities caused by prenatal exposure to pesticides containing organophosphates. The study estimated the harm done to unborn children costs society between €46.8 billion and €195 billion a year. About 13 million lost IQ points and 59,300 additional cases of intellectual disability per year can be attributed to organophosphate exposure.

“Adult obesity linked to phthalate exposure generated the second-highest total, with estimated costs of €15.6 billion a year.

“Our findings show that limiting exposure to the most common and hazardous endocrine-disrupting chemicals is likely to yield significant economic benefits,” said one of the study’s authors, Philippe Grandjean, MD, PhD, Professor of Environmental Medicine at the University of Southern Denmark and Adjunct Professor at the Harvard T.H. Chan School of Public Health. “This approach has the potential to inform decision-making in the environmental health arena. We are hoping to bring the latest endocrine science to the attention of policymakers as they weigh how to regulate these toxic chemicals.”

The impact of this paper is staggering. It should be a “wake up call” said Linda Birnbaum, Director of the U.S. National Institute for Environmental Health Sciences when asked about the results. It also provides more evidence that low level exposure to chemicals found in everyday household products is affecting the health of many people not just in the Europe, but worldwide.

Ted Glick: It’s Time to Seize the Moment and Ratchet Up the Pressure

For the third time in less than two years, I met yesterday with the chair of FERC, the Federal Energy Regulatory Commission. I was not alone. With me from the “good guys” side were Tracey Eno, leader of Calvert Citizens for a Healthy Community in Cove Point, Maryland; Jocelyn D’Ambrosio of Earthjustice and; via phone because her plane arrived late due to weather, Sandra Steingraber from href=”http://www.wearesenecalake.com/” target=”_blank”>We Are Seneca Lake.

On the “power” side were FERC chair Cheryl LaFleur and literally eight other FERC staff from various parts of their bureaucracy.

My first time meeting with the then-FERC Chair Jon Wellinghoff was in May of 2013. The second time was last June with Cheryl LaFleur. In both cases, as was true of this one, the meetings happened after I and others had gone to one of FERC’s monthly commissioners’ meetings and made our presence felt.

A month ago, after going to FERC with representatives of Green America for a meeting they had set up with Commissioner Phillip Moeller, I was “banned,” the security guard’s word, from the FERC building, escorted out of the meeting room on the 11th floor we had been taken to just as the meeting was about to start. However, several hours later, after contacting someone I knew in the press, I got a call from the executive director of FERC apologizing and telling me I was not banned.

The meeting yesterday was requested just before my temporary banishment. It was requested on behalf of Beyond Extreme Energy, which has been ratcheting up the pressure and putting a public spotlight on the many serious problems with the way FERC works. Robert F. Kennedy, Jr. has called it “a rogue agency.”

What was our hope in requesting the meeting? Our hope, slim as we knew it to be, was that perhaps in the context of a “civilized” sit-down in this way, we could see some signs that the campaign that has been building over the last couple of years to make FERC work for the people and not the fossil fuel industry has had some impact.

There was little sign of that yesterday. After we raised our well-reasoned criticisms of FERC, their rubber-stamping of proposed gas infrastructure expansion projects, their minimal efforts to prioritize wind and solar technologies, they didn’t have much to say. After we pushed it, LaFleur did reference some rule changes they had made to make it easier for those technologies to become part of the electrical grid, and another person did want to know more of our thinking about what they should be doing in the area of renewables. But as Steingraber said afterwards, LaFleur’s main response was to say, in effect, “We’re trying to take it in, we are listening,” little more.

The one exception to this was in the area of FERC’s processes—their website, the meetings they set up and how they deal with administrative appeals after granting a permit for gas infrastructure expansion. There was a bit more, not much, back and forth with FERC staff in these areas. Perhaps, over time, we will see some modifications. Time will tell.

The meeting made crystal clear that we need to sieze the time and ratchet up the pressure. Fortunately, Beyond Extreme Energy is doing so, moving forward with its week-plus of action at FERC from May 21-29. That’s when our growing movement can show our power and speak the truth in powerful ways to those using theirs wrongly. Our children and grandchildren are calling upon us to step it up right now!

Health Studies: What you can expect and what you can do

Whether your group is new or has been organized for years, one of the most pressing questions you’ll face is about health problems in your community. Typically, if you raise enough public attention and pressure, the state will ask the Agency for Toxic Substances and Disease Registry (ATSDR) to do a health study. While you may initially be excited, be careful what you ask for. ATSDR has a poor track record at investigating health problems in communities. You are more likely to get a result that is “inconclusive by design” than you are to get an honest answer to your questions. At least that’s what history tells us.

You can expect at least two things from ATSDR: First, the agency is going to treat your community like every other community that they have gone into. Second, ATSDR is going to use the standard methods they use to evaluate and investigate the health problems in your community.  Unfortunately, these scientific methods cannot answer with any accuracy or assurance the questions that people have about health problems in their community. The best state-of-the-art scientific methods that ATSDR will use cannot determine what’s causing an increase in cancer, birth defects or any other adverse effect in a population of people.

In 99 out of 100 instances, health studies conducted by ATSDR or other government agencies are inconclusive or at best incapable of determining what might be causing an observed increase in a disease found in a community. Given this likely outcome, it’s critical to have a plan for how to get the most from a health study done in your community.

One important step is to define as a community what you want. Do you want a typical epidemiological study where a questionnaire is distributed throughout the community asking about health problems and the results are then compared to a matched unexposed community? Do you want a clinic set up in the community where people could be tested to evaluate their health? Maybe some portion of the community wants to be relocated or evacuated and you want ATSDR to recommend such action.

Once you’re clear on what you want, then you need to figure out how to achieve these goals. This will take some strategic planning and a strong organized community effort. Ask these three questions about the health study, the answers to which will give you a good sense of the intent of the investigators and the limits of the study:

  • What are the goals of the investigation?
  • How will the investigators get the information they need?
  • How are they going to release the results?

Based on what you find out, you may decide that you don’t want to participate in this study. Or you may decide you want to change the agency’s plan to something that will be useful to your group. Changing their plan will require a strong organized community effort and a plan to get your points across to the agency. CHEJ can help you develop a plan to address a health study. The Circle of Poverty and Poison

This past month I’ve spent time with several grassroots organizations fighting to protect their families from environmental chemical threats. In each case I was reminded of how impossible it is for parents, with dreams of a bright successful future for their children, to achieve their goals while living in the circle of poison and poverty.

Many parents in low wealth communities, tell the story of how they work hard to support their children in school. Moms and dads make sure their homework is done, provide the healthiest breakfast and lunch they can afford and attend as many meeting and events that time allows. They want their children to succeed in school, to learn the skills needed to later secure a job that will bring them a better life.

Yet, no matter how hard parents try they often can’t stop the environmental poisons in the air, water or land. As the children leave for school the toxic air triggers an asthma attack. A parent must lose a day of work, daily earnings, and take the child to the hospital or care for the child at home. When a child is exposed to other environmental chemicals, or maybe even the same ones that cause the asthma, they can suffer from various forms of central nervous system irritants that cause hyperactive behaviors, loss of IQ point or a host of other problems that interfere with learning potential.

The end result is the child becomes frustrated because s/he can’t keep up with what is required at school because of being sick or unable to focus and often drops out of school. That child and the parent’s dreams disappear. A healthy baby, poisoned for years from environmental chemicals, life is forever altered. Often unable to earn enough money to ever leave the poisoned community, possibly even raising their own families in that same neighborhood, continues another generation within the circle of poverty and poison.

America’s environmental protection agencies are responsible for a healthy environment. As we all know the agencies fail often and even more frequently in low wealth communities. In my conversations with leaders in such areas I hear over and over again, parents saying we had so much hope for our child but the chemicals destroyed that hope. Our family can’t afford to move and our children can’t succeed if we stay and they are poisoned. What are families supposed to do?  I can’t answer that question, except to say keep speaking up and out. Can you answer parent’s cries for a solution?

Health Effects of Fracking – New Evidence

The evidence linking adverse health effects and exposure to chemicals generated during the natural gas extraction process of hydraulic fracturing (also known as fracking) continues to mount. The latest evidence, published in the journal Environmental Health Perspectives, found that people living near natural gas wells may be at increased risk for adverse health impacts including respiratory and skin conditions. The study examined nearly 500 people in 180 households in Washington County, PA, home to some of the most intense fracking activities in the U.S. The authors found that residents who lived less than a kilometer (about 2/3 of a mile) from a gas well reported more adverse health symptoms than residents who lived more than 2 kilometers from a gas well (about a mile and a third). Residents living less than a kilometer from a gas well were also more likely to report skin conditions during the past year as well as upper respiratory symptoms. The effects did not go away when adjusted for potential confounding variables including age, cigarette smoking, education level and occupation. The study did not find an association between proximity to a natural gas well and increased cardiac, neurological or gastrointestinal symptoms. According to the author, this study is the largest to examine general health conditions among people living near fracking sites.

Researchers from Yale University, the University of Washington and Colorado State University collected their data by going door-to-door and asking people to participate in a general health study. The authors followed the study participants for two years from 2012 to 2014. They did not tell people that the study was looking at the adverse health effects of fracking. The authors hoped this approach would reduce the potential for bias in people reporting the results. There are plans for an even longer term study.

The authors concluded that “airborne irritant exposures related to natural gas extraction activities could be playing a role. Such irritant exposures could result from a number of activities related to natural gas drilling, including flaring of gas wells and exhaust from diesel equipment.” According to the authors, the results underscores the need for ongoing health monitoring of people living near natural gas extraction activities in order to better understand the potential health risks. “We’re at a stage in which we know enough to recommend prudent precaution and exposure reduction,” stated Peter Rabinowitz, one of the co-authors, from the University of Washington.

Ohio Govenor Kills Green Energy & NYS Invests

It was only a short while ago when the Ohio Legislature essential killed all efforts to bring clean green energy and energy use reduction to the state. Ohio Gov. John Kasich dashed the hopes of environmentalists, leading manufacturers and renewable-energy businesses in June when he signed a bill shelving requirements for utilities to ramp up the use of renewable energy and energy efficiency. Kasich welcomes fracking and other nasty industrial processes to his state while other states are taking a more proactive and protective direction.

Recently, New York Governor Cuomo announced a ban on fracking in NY sighting the many unknown health issues that  have not been addressed and the potential impacts are too great to allow fracking to proceed in the state at this time.

Acting Health Commissioner Dr. Howard Zucker said that in other states where fracking is already happening, he found that state health commissioners “weren’t even at the table” when decisions about the process were made.

Zucker add “I cannot support high-volume hydraulic fracturing in the great state of New York,” also noting that he would not live in a community that allows fracking and would not want his children to play in the soil in such a place.

We give the Governor of NY an A+ for his due diligence in protecting the citizens of NY and the Governor of Ohio a big fat red letter F for his lack of caring or concern for the residents of his state.


This January 2015 NYS Governor began pushing for investments in clean green energy.
