EPA Passes Regulations for Forever Chemicals: Good News and Bad News

Earlier month, the US Environmental Protection Agency (EPA) finalized drinking water standards for a group of substances known as Forever Chemicals. These chemicals include PFOA, PFOS, PFNA, PFHXs, PFBS, and GenX and are generally described as polyfluoroalkyl substances (PFAS). PFAS chemicals are present everywhere in the environment, degrade very slowly and posed health risks to people who are exposed to them. They are called forever chemicals because they break down so slowing that they are around for centuries, essentially forever.

This new regulation requires that these forever chemicals be added to the substances that EPA requires all public drinking water systems to routinely monitor. Some water companies will start testing for PFAS in drinking water as early as 2027 in 3 years, but these restrictions don’t go into effect until 2029, five years from now. This regulation does not apply to private or individual wells, just to large public water systems.

While it’s good news that PFAS chemicals will be restricted in drinking water by 2029, this decision also highlights the slow cumbersome way that chemicals are regulated in this country. Although EPA made clear that there are significant and severe adverse health effects associated with these chemicals, the agency did not restrict their production or use in consumer products, just their presence in drinking water, and not for another 5 years. So, Dupont, 3M as well as other companies will continue to make these chemicals for use in consumer products. Furthermore, this new regulation only applies to 5 of the thousands of different PFAS compounds that have been identified.

Why does this make any sense? It certainly does not make any public health sense. EPA acknowledges the adverse health effects of these chemicals at extremely low levels, to the point where some researchers feel that there is no safe level of exposure to PFAS chemicals, yet EPA takes no action to restrict the production of these substances and gives water companies five years to meet its new standards. And for the companies that manufactured these chemicals – primarily DuPont (and several subsidiaries) and 3M – there’s no action against them or accountability for producing these substances for more than 50 years, even though for decades they opposed any regulatory action by EPA.

Over these years of delay, these companies slowly began moving away from the  PFAS chemicals that were targeted as “bad actors” – PFOA and PFOS – and began producing and using other PFAS chemicals about which virtually nothing was known about their toxicity. EPA has allowed this to happen even though the adverse health effects for most of these substances are not known. Somehow EPA seems good with issuing no restrictions on the production of potentially toxic consumer products and instead offers general advice to the public on steps they can take to avoid PFAS chemicals if they choose to do so.

There is something seriously wrong with our system for regulating toxic chemicals when the companies that use dangerous toxic chemicals to make consumer products for profit get off Scot free and the EPA offers advice to individuals on how to avoid these toxic products.

Industry began using these polyfluoroalkyl substances in the 1940s in consumer products such as nonstick cookware (Teflon) and in food packaging, to waterproof clothes, stainproof furniture and in certain manufacturing processes. They were also widely used in firefighting foams to extinguished fires, especially at airports and on training grounds for firefighters. PFAS chemicals gained public notoriety about 10 years ago when they began showing up in drinking water at military bases, such as the Pease Air Force Base in Portsmouth, NH. The US military estimates that there are over 600 military bases with PFAS contamination.

The adverse health effects associated with these forever chemicals include reproductive effects; developmental effects such as low birth weight, bone variations, and behavioral changes; damaged immune function such as reduced ability to fight infections; interference with the body’s natural hormone functions, including the thyroid; kidney and testicular cancer; liver damage; and increased cholesterol.

Commitment to Tackling Risks Posed by Toxic Chemicals

In a recent development highlighting a personal commitment to addressing the perils associated with toxic chemicals, the current administration has intensified efforts to mitigate environmental and health risks.

According to Chris D’Angelo’s coverage in The Huffington Post:

  • The administration has initiated measures to limit hazardous waste and chemical exposures, including restrictions on open burning of waste explosives and the evaluation of cancer-causing chemicals.
  • Despite these efforts, the handling of the East Palestine, Ohio, train derailment, involving the burning of vinyl chloride, has drawn criticism for its potential health and environmental impacts.
  • The EPA’s proposed rule to limit the open burning of waste explosives aims to protect communities but does not directly address the concerns raised by the East Palestine incident.

Hazardous waste and toxic chemicals can wreak havoc on public health and ecosystems. Chemicals that seep into soil and waterways can disrupt habitats, harm wildlife, and contaminate food chains. This not only affects biodiversity but can also compromise the resources people rely on, like clean drinking water and productive agricultural land.

EHN visited residents still picking up the pieces four months after a catastrophic train derailment dumped toxics in East Palestine, Ohio.

It’s Time to Do Right by the People in East Palestine, OH – and Elsewhere

Nearly 10 months ago, a Norfolk Southern train with more than 150 cars, many of which contained toxic chemicals, derailed in East Palestine, OH. Thirty-eight of the train cars derailed and a decision was made by Norfolk Southern to burn the contents of 5 tanker cars containing vinyl chloride and other toxic chemicals. This unleashed a huge black cloud full of particulates that enveloped the surrounding neighborhoods and farms in both OH and PA.

Immediately after the burn, people in East Palestine began reporting adverse health symptoms including headaches, nose bleeds, skin rashes, central nervous symptoms, thyroid problems and more. These and other adverse health problems have continued to plague the residents of this rural midwestern town.

EPA immediately responded by telling people that everything was alright and there was no cause for alarm. EPA’s testing found no levels of “concern.” But the people in East Palestine could not accept this narrative because they knew things were not right. They knew the health effects they were suffering from were real. They knew that EPA was not telling them the truth.

If EPA were honest with the people at East Palestine, they would have told them that they didn’t understand why people were continuing to report so many illnesses while their data told them otherwise. But if EPA did acknowledge how little is known about the link between adverse health effects and exposures to mixtures of chemicals, the people of East Palestine would demand action in the face of these uncertainties. Actions like paying for relocations so that they can stop being exposed to the toxic chemicals that are still in the air and getting the health care they need to move on with their lives.

The people in East Palestine deserve better. So do hundreds of other communities across this country where people have similarly been exposed to low levels mixtures of toxic chemicals. It is clear from the situation in East Palestine that very little is known about how people respond to chemical exposures, especially to low level mixtures. This is evident when the EPA and other public health agencies who rely on traditional toxicology and risk assessment are telling the people of East Palestine that everything is safe when it clearly is not.

It’s time to acknowledge that the scientific understanding does not exist to explain what is happening to the health of the people in East Palestine. It’s time to recognize that we cannot rely on traditional toxicology to answer the questions people have about their exposures to low level chemical mixtures. It’s time to do the right thing by the people in East Palestine and by hundreds of communities across the U.S. where people are being exposed to low level mixtures of toxic chemicals. It’s time to acknowledge that the tools we have are not able to answer the questions people raise about their exposure to toxic chemicals and give people the relief they are asking for, whether it’s cleanup, relocation, health care or something else.   

It’s what the government did for the Vietnam veterans exposed to Agent Orange; for the atomic bomb victims exposed to radiation fallout; for the 9/11 first responders in New York City; for the soldiers exposed to burn-pit smoke in Iran and Afghanistan and other overseas locations; and for the Marines at Camp Lejeune, North Carolina who drank contaminated water. Do the people of East Palestine deserve anything less than the soldiers and first responders who protect this country?

In each of these instances, the government recognized that the science linking exposure and health outcomes was incomplete and instead of requiring proof of cause and effect, they said, “Enough, we will take care of our own.” They moved to a presumptive scientific approach that allowed veterans and first responders to  health care and other compensation. We should do the same for the people of East Palestine and in hundreds of other communities that have been exposed to low level mixtures of toxic chemicals.

Betraying the Public’s Trust – EPA’s Terrible Response to East Palestine, OH

Since immediately following the train derailment and intentional burn of toxic chemicals in East Palestine, OH, the USEPA has betrayed the public’s trust in government. The agency has put out a steady stream of statements telling people that everything is alright. They saw no reason to test for vinyl chloride, for example, even after the railroad company, Norfolk Southern, dumped 5 tankers cars into a ditch alongside the railroad tracks and then intentionally set it on fire. EPA did this with other chemicals as well.  

They continued to tell people that everything was fine even though they saw no reason to test for dioxin even though there was no question that dioxin, one of the most toxic chemicals every tested, would be generated when the vinyl chloride was burned.

The Region 5 Administrator got into the act when she said that EPA couldn’t test for dioxin because they don’t know what the background is. Really? And when EPA reluctantly agreed to test for dioxin, they immediately said that they expected to find dioxins at levels consistent with background.

Soon after the testing began, EPA repeatedly and aggressively downplayed the presence of dioxins and other toxic chemicals in East Palestine while providing little if any data to back up their claims. The agency seemed much more concerned with controlling a predefined narrative than they were with honestly responding to the concerns and questions raised by the public.

This is confusing because the agency is very familiar with dioxins. They understand the serious health risks that exposure to dioxins poses. For more than 25 years, the agency studied the health risks of dioxins. Exposure to dioxins can cause cancer, reproductive damage, developmental problems, type 2 diabetes, heart disease, infertility in adults, impairment of the immune system, skin lesions and more. Yet the agency has been desperate to convince the public that there is no cause for alarm.

My guess is that they are pushing so hard because they don’t have answers to the many questions people are asking about dioxins. While it’s not easy to address these questions, it’s irresponsible for the agency to pretend that dioxins are irrelevant.

The EPA‘s mission is to protect human health and the environment. Clearly the situation in East Palestine is the place where EPA should follow its mission and do right by the people who live in this community. EPA must conduct testing for dioxins and other chemicals that is intended to tell people specifically what they have been exposed to and then analyze the results in a way that helps people understand the risks they face.

The people who live in East Palestine have a right to this information so they can make informed decisions about their future. If EPA continues to betray the public’s trust, then the agency will be responsible for people living for years without clear answers about what happened in East Palestine, OH.

Toxic Tuesday: Dioxin

Dioxins are a group of toxic compounds that share similar and distinct chemical structures. They are mainly byproducts of industrial processes, such as waste incineration. In 1979, the EPA banned products containing Polychlorinated Bihphenyls (PCBs), which is a chemical included under the term dioxin. However, dioxins were a major issue before the US began implementing regulations. Since dioxins break down extremely slowly, toxins that were released long ago are still being released into the environment.
Today, most people are exposed to dioxins through consuming animal products that have accumulated dioxins over time. Exposure to these toxins in humans can cause cancer, type 2 diabetes, ischemic heart disease, infertility in adults, impairment of the immune system, and skin lesions. The following measures can help decrease your risk to dioxin exposure: removing skin from chicken and fish, trimming visible fat from meats, and checking local fishing advisories when catching your own seafood. The San Jacinto Waste Pits is a Superfund site in Harris County, Texas that is packed with dioxin and other toxic chemicals. Hurricane Harvey hit Harris County in 2017 and led to large damages and erosion throughout the region, causing the San Jacinto Waste Pits site to begin leaking toxic chemicals, such as dioxins into the surrounding communities.
CHEJ has worked with the Texas Health and Environment Alliance (THEA) and the San Jacinto River Coalition in order to help bring awareness to their nearby Superfund sites and the damages that hurricanes have caused. In 2017, THEA and the San Jacinto River Coalition succeeded in bringing attention to the waste pits and the EPA announced plans that they would remove the toxic contents from the pits entirely through a $115 million site remediation by late 2021.
In addition to THEA, residents in Wausau, WI living immediately adjacent to former Wauleco window manufacturing sites who were concerned about dioxin contamination formed Citizens for a Clean Wausau. Recent testing in a park found high levels of dioxin but the state dismissed the results. However, the state had to correct itself when CHEJ’s science director wrote a letter to the group pointing out that the state’s risk assessment failed to include dioxin’s cancer risk. Given dioxin’s high potency as a carcinogen, this was a major oversight. The group continues to fight for more testing. Earlier this year, the leader of the group ran for and won a seat on the city council, giving the group a great inside/outside approach to getting what they want. CHEJ continues to provide technical and organizing support to Wausau’s residents.

Flooding at Dioxin Superfund Site in Midland, Michigan

Midland, Michigan is still assessing the damages after torrential rain and dam failure flooded the area. The height of concern was the status of the U.S. Army Corps of Engineers’ Saginaw River Dredge Material Disposal Facility that houses dioxin contaminated sediments that could have spread from the storm water. The facility appears to have remained in tact; however, there is still concern that the flood could have spread river sediment already contaminated with dioxin from Dow towards residential properties. It may take some time to fully determine the extent of the damage in Midland as many properties are still under water. Read More.

Long Island Receives Grant Money to Clean Up Water Contamination

New York State Governor Andrew Cuomo has announced that the state’s Environmental Facilities Corporation will direct $120 million in grant money towards assisting Long Island and villages’ water plans. Included is the Village of Mineola that currently has three major water system projects underway to help meet 1,4-dioxin and PFAS treatment requirements. 23 total grants have been given out to Long Island and villages to assist in water remediation projects. New York bans certain cleaning products to reduce water contamination

Albany, New York Governor, Andrew Cuomo signed a bill yesterday, December 9, that will ban the sale of certain cleaning products, cosmetics and personal care products. The purpose of the ban is to reduce the risk of drinking water contamination from the 1,4 – dioxane chemical that can still be found in some consumer products. This bill will not go into effect until January 2022. Read More.

A look back – Times Beach, MO Evacuated 37 Years Ago

Times Beach made national headlines in December 1982 when state and federal health officials declared the town uninhabitable because its unpaved roadways were polluted with dioxin, a toxic chemical.  “Everything that was near and dear to the people in this community. All the houses and the city equipment. Everything that they didn’t take with them that was left in their homes is buried here,” said Marilyn Leistner, the last mayor of Times Beach. Read more.

Changing the Traditional Understanding of How Chemicals Affect Our Health

The way scientists think about how chemicals cause their toxic effects is changing. Recent scientific research tells us that the traditional notion of how chemicals act is being replaced by a better understanding of the actual features of exposures to environmental chemicals. These features include the timing and vulnerability of exposures, exposures to mixtures, effects at low doses and genetic alterations called epigenetics.
Traditional thinking tells us that how much of a chemical you are exposed to (the dose) determines the effect. This principle assumes that chemicals act by overwhelming the body’s defenses at high doses. We’re learning now that this principle is not always accurate and its place in evaluating risks needs to be reconsidered. What we now know is that some chemicals cause their adverse effects at low exposure levels that are not predicted by classic toxicology.
Recent research has shown that environmental chemicals like dioxin or bisphenol A can alter genetic make-up, dramatically in some cases.  These changes are so powerful that they can alter the genetic material in eggs and sperm and pass along new traits in a single generation, essentially by-passing evolution.
It wasn’t too long ago that scientists believed that the DNA in our cells was set for life, that our genes would be passed on from one generation to the next, and that it would take generations to change our genetic makeup. That’s no longer the case.
This new field – called epigenetics – is perhaps the fastest growing field in toxicology and it’s changing the way we think about chemical exposures and the risks they pose. Epigenetics is the study of changes in DNA expression (the process of converting the instructions in DNA into a final product, such as blue eyes or brown hair) that are independent of the DNA sequence itself.
What researchers are learning is that the “packaging” of the DNA is just as important as a person’s genetic make-up in determining a person’s observable traits, such as blue eyes, or their susceptibility to diseases such as adult on-set diabetes, or to the development of lupus.
The environment is a critical factor in the control of these packaging processes. We may be born with our genes, but epigenetics changes occur because of environmental influences during development and throughout life. These influences include chemicals in the food we eat, the air we breathe, the water we drink, and they appear to contribute to the development of cancer and other diseases.
Epigenetics may explain certain scientific mysteries, such as why certain people develop diseases and others don’t, or why the person who smoked for 30 years never developed lung cancer. There is still much to learn, but an early lesson to take away from this emerging science is that we need to rethink our traditional ideas of how chemicals affect our health.
