State Finally Makes Progress on East Chicago, IN

Residents living in more than 1,000 private properties in the middle and eastern parts of the Calumet neighborhood will not be moving as the U.S. Environmental Protection Agency excavates contaminated soil from around their homes. While of the 332 families living at the complex when the city issued a relocation order, 106 remained. They are facing a March 31 deadline to move.
State officials have completed some of the tasks required as part of an emergency declaration for East Chicago’s USS Lead Superfund site in the more than two weeks since it was signed into effect by Indiana Gov. Eric Holcomb. Water is being tested and excavation of contaminated soil has oved forward. Read more.

Victory for Families Relocating In East Chicago, IN

Gov. Eric Holcomb signed an executive order declaring a disaster emergency for East Chicago’s USS Lead Superfund site.
The declaration provides for 30 days of enhanced state assistance for the estimated 100 residents who have yet to relocate from the lead contaminated West Calumet Housing Complex, as well as other lead-impacted citizens in the affected area.
Governor Holcomb did what Pence refused to do last year. Residents and community groups heavily criticized Pence last year for not meeting personally with those affected by the lead and arsenic contamination. Read more.

Chemicals Reduce Childrens IQs

If you are interested in how many small amounts of chemicals can directly impact children’s IQ you need to spend a few minutes watching this video. CHEJ’s members have been frustrated by the regulatory agencies and their lack of willingness to address multiple chemical exposures. Most recently the Just Moms group in St. Louis, MO were told that a leader’s family has levels of radiation in their kitchen 200 times above background. How in the world do  you make Thanksgiving dinner in a kitchen full of radiation? Moreover, how can you have a family dinner when no one wants to come to your house? Along with the radiation are toxic chemicals that come from the burning landfill daily. EPA says they need to do more testing. How much evidence does the agency need before they move the people?
Karen Nickel with Just Moms STL says, “Allowing people to live inside of homes that are contaminated with the world’s oldest nuclear weapons waste is unacceptable and extremely irresponsible. For over five years, the community has endured breathing in toxic fumes from the underground fire at the landfill and there’s no clear end in sight. The Missouri Attorney General indicates a Chernobyl-like event could occur if/when the underground fire collides with the Manhattan Project waste. The schools in the area are on alert for a shelter-in-place event and have asked parents to stock-pile their children’s medication at school in the event they cannot be released. There is a higher than normal incidence of brain cancer in children under 17 in areas around the West Lake Landfill. Families are sick with bloody noses, asthma, and other respiratory illness and often keep children indoors because the toxic odors are so bad.”

Samsung Refuses Workers Pleas For Help

Standing together in solidarity with injured workers from Samsung. It took Samsung 14 days to apologize to consumers for phones that caught fire and today, over seven years after young men and women died and/or injured working in the plant Samsung remains silent.
Too many young men and women were made sick in the plant. They are asking you to stand with them and don’t purchase their products until Samsung addresses the workers injuries. Hye-kyung Han is in the wheelchair of photo. She cleaned circuit boards with no ventilation resulting in a brain tumor. Many of her co-workers died before the age of 35 years due to cancers. EPA to Remove Dioxin-Laced Contamination from River in Houston

 Congratulations to the San Jacinto River Coalition of Houston,  Texas and residents who live near the San Jacinto Waste Pits  Superfund Site for convincing the US Environmental Protection  Agency (EPA)that the only acceptable solution to address the  dioxin contaminated paper mill sludge waste in the pits was to dig  it up and take it out! At the end of September, the EPA agreed after  more than 6 years of controversy and analysis, to remove about 202,000 cubic yards of toxic waste from the site at a cost of approximately $97 million. The decision is not yet final as the agency is holding a 60 day comment period.
This site is located on 20 acres of abandoned land along the San Jacinto River that runs just east of the city of Houston. Sludge waste from pulp and paper mill production at nearby International Paper and before them Champion Paper was dumped at this site during the 1960s and has been leaching from the waste pits into the river ever since. A large portion of this property is continually underwater from the San Jacinto River causing dioxin contaminated sediment to come into direct to contact with the river water. Dioxin levels as high as 46,000 parts per trillion (ppt) have been found in the waste pit area. An action level of 1,000 ppt of dioxin in soil was used by the EPA to evacuate the entire town of Times Beach, MO in 1983. Dioxin is one of the most potent carcinogens ever tested and has been associated with a wide range of adverse health problems including reproductive, developmental, immunological, and endocrine effects in both animals and humans.    
The San Jacinto River Coalition formed in 2010 to address the contamination coming from the Waste Pits and to push EPA for complete removal of the contamination. EPA was inclined to leave the waste in place which made absolutely no sense to anyone who lived in the area as local residents watched the river routinely submerse the waste completely. A major concern has been dioxin leaching into the river because so many people fish the river and continue to do so even though the state has issued a fish advisory warning people not to eat the fish. For many local residents, fishing in the river is a main source of food.  
Jackie Young, director of the San Jacinto River Coalition was elated at the agency’s decision and was quoted in the Houston Press saying: “Leaving the waste in the river is unacceptable…This decision shows that the EPA is taking a firm stand based on the science and engineering and what the community has called for.” Sometimes the little guy does win. Water Pollution – What’s it All About?

Our water in the US is supplied by lots of sources. Groundwater makes up about 25% of water used, while surface sources like rivers, lakes, or reservoirs make up the remaining 75%. Most of our water is used for thermoelectric purposes, irrigation and public supplies (2005). But water is also important for industry and farming, since it can be used for almost every step of producing everyday goods like food, paper, chemicals, petroleum, or metals. The water cycle doesn’t end there, though. The water used in production needs to flow somewhere, and a lot of times it goes back into rivers.
In a 2004 fact sheet by the Environmental Protection Agency (EPA), US water sources were declared too impaired by pollution to support their use: ‘In 2004, states reported that about 44% of assessed stream miles, 64% of assessed lake acres, and 30% of assessed bay and estuarine square miles were not clean enough to support uses such as fishing and swimming. Less than 30% of U.S. waters were assessed by the states for this report. Leading causes of impairment included pathogens, mercury, nutrients, and organic enrichment/low dissolved oxygen. Top sources of impairment included atmospheric deposition, agriculture, hydrologic modifications, and unknown or unspecified sources.’
Knowing the numbers is one thing, but knowing what that means for the general public is another. What does it mean to live near a contaminated river or reservoir? If the pollution exceeds a certain level of concentration, it means that your community’s main water source is not fit to drink. More than 100,000 miles of rivers and streams in the US have poor water quality due to factory farming. One single agricultural company, Tyson Foods, causes 104 million pounds of pollution in our surface sources of water within four years. One can only imagine the impact that the whole of US agriculture must have on our water supplies – not to mention other industries and big oil.
With public awareness growing and environmental movements on the rise, how can industrial and agricultural pollution still happen at this large scale? A big portion of water pollution is backed by outdated policies or lack of those that control the amount of pollution. Policies that do exist are enforced poorly and inconsistently which lets industries bypass or ignore laws. Unplanned industrial growth and a number of small scale industries with lack of funding for better technologies influence water quality as well. Often times, it is lower income and marginalized communities suffering the most.
The main issue that stems from water pollution is the impact on health. Polluted water can contain chemicals like fertilizers and pesticides, industrial wastewater, heavy metals, and even radioactive waste. The impacts on communities can be dreadful, and ecosystems are being harmed beyond repair. Failing ecosystems put a strain on many parts of our modern day lives. Fish living in contaminated waters can easily ingest pollutants and carry them into the natural food chain. Habitats are being lost and species are on the brink of extinction, major disasters like oil spills damage public and private properties. The list of consequences seems endless. We all know that coming in contact with these pollutants can cause diseases like cancer, painful rashes, issues with liver and kidney, and disturbance of the nervous system. Children are especially vulnerable: In the Flint water crisis, officials found lead levels in the water causing low IQ, shortened attention span, and increases in violence and antisocial
behavior. It can adversely affect major organs of the body and the effects are irreversible.
All these facts might feel almost insurmountable. But let’s focus on what we can do to change the way people look at our water, and to reduce pollution and the effect it has on our lives. There are many approaches to help keep our water sources clean.
Look at your own water footprint and the footprint of the food you’re eating and the goods you’re using. See what you can change about your lifestyle that would reduce it. See how we impact our water sources.
Look for companies that use environmentally friendly methods and sell biodegradable products instead of chemical cleaners and harming industrial practices. Buy local.
Advocate for your cause. If you change opinions of your friends and family, and if you educate them about water and all the issues revolving around it, they might do the same. It only needs a small number of people to start a movement. Spread the word.

The New Lead – Perfluorinated Compounds (PFCs)

It’s bad enough that lead is making headlines everywhere, but now a new group of chemicals is showing up in drinking water across the country – in Portsmouth, NH, Hoosick falls, NY, Scottsdale, AZ, Colorado Springs, CO, Decatur, AL, Bucks County, PA, Cape Cod, MA to name a few places. These chemicals are called perfluorinated compounds, or PFCs and they first generated headlines in the 1990s when they contaminated the drinking water for 70,000 people of Parkersburg, WV where a DuPont plant made teflon and related products for decades. Exposure to these chemicals is linked to developmental delays in children, decreased fertility, increased cholesterol, changes in the immune system, and cancer (prostate, kidney and testicular).
PFCs are quickly becoming the “hot” chemical to look for in drinking water as it seems to be showing up everywhere including places such as the Pease International Tradeport Business and Industrial Center in Portsmouth, NH. In the summer of 2014, the City of Portsmouth reported that two unusual chemicals were found in all three wells that serve the business center as well as the NH Air National Guard Base on the site of the old Pease Air Force Base. The concentration of one of these chemicals – perfluorooctanesulfonic acid (PFOS) – exceeded the USEPA Provisional Health Advisory (PHA) causing the city to immediately shut down the well. PFOS and perfluorooctanoic acid (PFOA) are part of the class of chemicals known as perfluorinated compounds, and they are starting to show up in drinking water wells throughout the country.
PFCs are common in many consumer products, including teflon pans, fabric protectors, pizza boxes and ski wax and it is used to make carpets, clothing, fabrics for furniture. They are also used to fight fires and in a number of industrial processes. At the Pease Air Force Base in Portsmouth, the water became contaminated when firefighters practiced putting out fires on abandoned portions of the airbase using firefighting foams that contained PFCs.
PFOA and PFOS contamination in drinking water is thought to stem from two main sources: factories that formerly manufactured or used the chemicals, and locations, including military bases, where they were used in firefighting foams. According to the EPA, both PFOA and PFOS are found at very low levels in the blood of the general population across the U.S.
Although no one lives at the Tradeport Center, more than 10,000 people work there and there are two day care centers. The people who use the daycare centers immediately formed a Facebook page called “Testing for Pease” and began asking for blood testing for the children. Soon more than 500 adults and children had their blood tested for PFCs and many had levels that were higher than the general population. More blood testing is now underway as the community struggles to make sense of the results and what it means for their future. The health effects of PFCs are not well understood but studies in communities with similar exposures found associations with kidney cancer and testicular cancer. Other concerns includes high cholesterol, immune damage and possible reproductive effects.
In May of this year, the EPA finalized its Health Advisory for PFOA and PFOS lowing its advisory value from 400 and 200 respectively to 70 parts per trillion (ppt) for both compounds combined. This level was based on a lifetime exposure to total PFCs. This change followed criticism from researchers at the Harvard University School of Public Health that the original PHA was not adequately protective of the public.  This health advisory is based on long term exposure to PFOA and PFOS in drinking water.

What if government knew your water was toxic in 2008 and told you in 2016?

I’d be outraged. This is a real life situation. It took eight years for water results to be analyzed and reviewed by the federal public health agency for a small Pennsylvania community. They concluded that drinking water was not safe to drink; and that the agency has no information about water contaminates from 2011 through 2016.
Is it safe now?  Although samples were taken over the eight-year period, no one knows. The federal health scientists have never seen those results. Even if they did, it might take another eight years to get the results — that would be 2024.
This is terrible . . . right?  Unfortunately, it actually gets worse. The state health scientists said that same water was safe to drink, as did the federal Environmental Protection Agency (EPA) after reviewing the same sample results.  . . . yet the water was poisoned. It is unknown how many people mixed baby formula or bathed their young children in this toxic water.
I looked into why now, in May, 2016, did the federal Agency on Toxic Substance Disease Registry (ATSDR) release a report concluding the water was unsafe to drink. I found a recent news story that announced that the victim’s lawsuit against the polluter was recently settled in court. This settlement, in Dimock, Pennsylvania against Cabot Oil & Gas was the only change in the situation.  Although I could be wrong, my conclusion was that the agency decided not to get involved in the messy trial of a multinational corporation. Instead, allowed a community to be poisoned. If that’s true, then I have no confidence nor hope that the American people are protected by their own public health government agency. In fact, it reaffirms for me that our public health protections are controlled by polluters and their lawyers.
Families, young children, and women of childbearing age drank toxic water with false assurances of safety from the very agencies charged to protect them. What is the public supposed to do? Whom can they trust?  Why can’t our health authorities act in the best interest of public health of the American people who pay for their services through our tax dollars?
For the past thirty five years, I’ve watched the criteria for health assessments go from the preponderance of evidence (collection of all relevant studies, their quality, sources and conclusions) to obscure abstract mathematical assessments.  In the past five years, it’s gotten worse. When results are undeniably harmful to public health, even using this abstract model, the results are held from the public, with agencies utilizing “draft” as reasons for not releasing reports to the public. All this time, health professionals know people are being exposed to unnecessary, and in some cases, avoidable health risks. You need not look any further than what is still happening in Flint, Michigan with their drinking water to understand this problem.
The jury’s verdict on water contamination in Dimock may have broad implications for the broader debate about the environmental risks of the shale drilling rush nationwide. Although the case did not center on claims that the fracking process (as opposed to drilling, well casing failures, spills or other problems) had directly caused the water contamination, most of the gas wells that the plaintiffs focused their attention on were aimed at the Marcellus shale gas formation.
Kassie Siegel, director of the Center for Biological Diversity’s Climate Law Institute, commented, “This is a huge victory for the people of Dimock, but it’s also a sharp rebuke to the Obama administration for failing to fully investigate threats posed by fracking and dangerous drilling to water supplies in Pennsylvania and across the country. Because of the EPA’s disturbing history of delay and denial, it took a federal jury to set the record straight about the natural gas industry’s toxic threat to our water.”

What We Don’t Know about Toxic Chemicals

So often people believe that the solution to their problem lies in science and technical information. How often have you heard some company spokesperson speak to the need for sound science. At CHEJ, we have have learned many lessons about science and how it is used. Science and technical information is important and has a role in helping to achieve your community goals. Identifying this role and learning how to use scientific and technical information is critical to the success of your group.
The most important lesson is that science and technical information alone will not solve your problem(s). It’s reasonable to think that if you hire the best scientists and engineers and make solid technical arguments, the government will do the right thing. Those of you who have been there know it doesn’t work that way.
When the government discovers a problem, it’s reluctant to determine the full extent of the problem. This is because if the government documents contamination that threatens people’s health, it then has to do something about it—like evacuate people or clean up the contamination. This costs money that government doesn’t have or want to spend. Such action might also set a precedent by establishing cleanup standards or unsafe exposures levels that would mean spending more money at other sites
Deciding what action to take is complicated by the fact that there are few answers to the many scientific questions raised by exposures to toxic chemicals. Scientists actually know little about the adverse health effects that result from exposure to combinations of chemicals at low levels. As a result, when politicians and bureaucrats look for answers, the scientists don’t have them. They have their opinions but no clear answers.
Most scientists however, are reluctant to admit they don’t know the answer to a question. Instead they introduce the concept of “risk” and begin a debate over what’s “acceptable.” This process hides the fact that scientists don’t know what happens to people who are exposed to low levels of a mixture of toxic chemicals. This uncertainty gets lost in the search for what’s “acceptable.”
Because of the lack of scientific clarity, bureaucrats and politicians use science cloaked in uncertainty, not facts, to justify their decisions which at best are based scientific opinion, but more likely driven by the political and economic pressures they face. Whether this is right or not is not a scientific question but an ethical and moral question. It is foolish to think that in this setting, science can be anything but a tool used by politicians and corporations to get what they want.
While science and scientific information have failed to provide clear answers and solutions to the hard questions about the health and environmental impact of the chemicals we use, we cannot abandon science. Science and scientific information can be a powerful tool for community groups, but only if you recognize what it can tell you and what it can’t, and only if you learn how to use the information and not just collect it. The right information used in the right way at the right time can be very powerful. Learning how to use scientific and technical information strategically is an organizing skill. Just Moms STL & CHEJ File Complaint with United Nations

May 3, 2016 — This afternoon Dawn Chapman, Karen Nickel, from Just Moms StL in St. Louis, Missouri, Lois Gibbs, Center for Health, Environment & Justice delivered a request on behalf of American families living in harm’s way of a Chernobyl like event to the United Nations Special Rapporteur on Human Rights and the Environment, Mr. John Knox. Ms. Nicole Bjerler, Mr. Knox’s colleague will be meeting with the Just Moms STL delegation to accept the Tribunal Summary Documents, Complaint and Transcript as he is currently in Switzerland.
The community has exhausted every possible government and non-governmental option for relief within the United States leaving the United Nations as the next level of authority.
Community has asked the state to act but only have been informed of the pending crisis of a “Chernobyl like event,” (Attorney General, MO). The US Environmental Protection Agency (USEPA) has done little since 1990 and done little to date to stop the fire from reaching the radioactive wastes. State and federal legislators have introduced a federal bill that would transfer the cleanup from USEPA to the Corps of Engineers because of no confidence in US EPA. The bill passed the Senate and is in the house committee being queried. This bill does nothing to relieve the daily exposures and urgent need to get out of the area before an explosion or other disastrous event.

  • On a daily basis flares around the Bridgeton landfill, which is burning beneath the surface, release chemicals that are toxic to human health at levels above permitted health based standards. These chemicals travel through the air and into the surrounding community. Children waiting at bus stops and playing outside must breathe this toxic air.
  •  Although there is cover over the burning landfill, however when materials below the surface burn and reduce in size, the cover material collapses causing a rupture in the cover material. This results in smoke containing toxic chemicals to be released into the air of the surrounding community. Smoke at times is so thick that it is difficult to maneuver an automobile due to visibility and travels across the street blanketing adjacent homes and playground.
  • The entire site which was designated a U.S. federal Superfund site in 1990. Yet the USEPA has failed to complete mapping of the site to define where the buried radioactive waste is located. After more than two decades no one understands where the radioactive wastes are.
  • Children are suffering and dying from cancer at an alarming rate. State health studies have clearly documented increased childhood brain cancer risks in nearby neighborhoods. Today the number of children with brain cancer is over 300 times what would be expected.
  • Public schools are concerned about an event which will cause students and school employees to remain in a “shelter in place” situation for a long period of time. Parents were asked to bring to school a supply of medications that children take before and after school in the event they cannot go home. This is an unacceptable situation especially for preschool children ages 3 to 4 to be without their parents overnight.
  • Families with members that are vulnerable to respiratory impacts are at risk daily. Windows must remain closed year round. Outdoor activities such as yard work, home repairs and organized sports are near impossible. Quality of life standards are negatively impacted as a result of not being able to sit outdoors, decorate for holidays or enjoy a child’s sporting event.
  • Lastly, tucking your child into bed at night or sending them to school in the morning and not knowing if an event will occur that day, as a result of the fire reaching the radioactive wastes.
