Love Canal Déjávu – Ground Hog Day?

I couldn’t believe what I was hearing and seeing when I clicked on a link that connected me with a news story about Love Canal by the local ABC TV station in Buffalo. There in front of a camera was a young woman who reminded me of myself 35 years ago. Christen Morris talked about chemicals that have become visible, about trees dying, pets with cancer and growths, and many people who are sick.

I can remember saying those same words, making that same case in 1978 to EPA and the NYS Department of Environmental Conservation. Wow. At the same time as Ms Morris and others were speaking out about problems in the neighborhood, classmates who attended the 93rd Street School were sharing notes. 93rd Street School was located in the northern part of the community, and also demolished due to contamination. Former students, at a class reunion, began exchanging notes about how sick they were finding common concerns and disease. They believe their health related problems might be linked to exposure to Love Canal chemicals during their elementary school years.

Former student Laura Racine said, “I went to the reunion and decided to seek out all the kids that went to the 93rd Street School with and see if they were having health issues as well. And nine out of ten of them were having health issues.”

It is so hard to watch these news stories. It has never made any sense to me or other former residents of the area, why the state and federal government insisted on repopulating the northern part of the evacuation area or why they refused to follow the young children from both 99th and 93rd Street Schools. These are innocent people who were children and whose parents were assured that no long term health problems were likely. The public was assured that Love Canal was cleaned up, when actually the 20,000 tons of chemicals are still there, still in the center of the dump. Only a clay cap and trench system to capture anything that might move out horizontally was put in place. There’s absolutely no science that supports the government’s theory that the chemicals will stay put. All landfills leak and Love Canal is no exception. In fact, the Love Canal dump has no bottom. So, it leaks chemicals out the bottom every time the Niagara River levels drops . . . like in August for example.

The families living around the dump are not to blame. So many people want to – blame the victims. People were assured by every imaginable government agency that everything is fine. The most frequently used phrase to people who inquired was, “Love Canal is the most tested neighborhood in the country.” Of course that doesn’t mean its safe but those words along with assurance of safety people became convinced.

It will be painful to watch the new effort unfold as families with sickness and questions struggle to get those answers. I plan on helping where I can. To see recent news story click here.

Over 5,000 March On D.C. To Stop Fracking

Over 5,000 people traveled from all over the country this past Saturday July 28th to be part of a rally and powerful voice against fracking on the West lawn of the U.S. Capitol. Their goal: to end dirty and dangerous fracking; closure of the seven legal loopholes that let frackers in the oil and gas industry ignore the Safe Drinking Water Act, Clean Air Act and Clean Water Act; and full enforcement of existing laws to protect families and communities from the effects of fracking. Not unreasonable demands given that hydro fracturing for gas or “Fracking” has already destroyed people’s land, water, air, property and health. Asking congress to stop this destructive practice is a no brainer but then some in congress don’t act on intellect but only focused on greed and/or how they can get reelected.

Congress has the power to stop the fracking of our country and the destruction of the American Dream for so many people. The fracking industry, astonishingly, doesn’t even have to adhere to the laws that other industries are held to like the safe drinking water act — a critical law — because when there is no safe water people die.

If you were at the rally you would have experienced people’s feelings of fear and frustration among many who were gathered to speak to the issue and talk with congressional representatives. So many of the participants expressed how they have experienced or fear their lives being destroyed, their families left helpless and frustrated because they cannot stop the frackers. “Our land has been in our family for generations and now it’s poisoned, polluted and unusable. We received no benefits, no money from the frackers and today we have nothing but poisoned land not fit for livestock or crops. This is so wrong,” said a grassroots farmer from Pennsylvania.

“I support any legislation that we can get passed that will cost the companies money,” said another activist who attended the demonstration. “I don’t think that there can be a safe form of fracking.”

If you were at the rally you would have also been swept up in the enthusiasm, energy and sense of power people felt. Together we are strong . . . together we can make a difference, said many of the participants. There were all kinds of people there, young, old, farmers, businessmen and women, rich, poor, black, white, brown a reflection of the diverse American populace.

Rally speakers included, Bill McKibben, co-founder of 350.org; Josh Fox, producer of Gasland; Calvin Tillman, former mayor of Dish, Texas; Allison Chin, board president of the Sierra Club, and community members from swing states affected by fracking. After the rally people marched for more than one hour, stopping at the headquarters of the America’s Natural Gas Alliance and American Petroleum Institute.

“As the increasingly bizarre weather across the planet and melting ice on Greenland makes clear, at this point we’ve got no choice but to keep fossil fuels underground. Fracking to find more is the worst possible idea,” said McKibben.

This was an impressive rally with grassroots people impacted by fracking in their communities joined together with 136 local and national organizations to call on Congress to Stop the Frack Attack and protect Americans from the dangerous impacts of fracking. CHEJ was proud to play a small role in the event.

NC Legislator Fracked It Up

Governor Bev Perdue vetoed the controversial fracking bill Sunday, July 1st the last day she had to act before it would have become law.

The governor said she supports hydraulic fracturing, also known as “fracking,” but believes additional safeguards are needed in the bill. Without those safeguards in place to protect drinking water and the health of North Carolina families, Perdue said she was forced to veto the bill. “If they improve the bill to strengthen the protections for North Carolina families, I will sign it into law.”

Then two days later, Representative Becky Carney solved the problem for the Governor when she accidentally voted to override her veto.  That’s right accidentally pushed the wrong button.  Unbelievable.

The most important job of an elected representative is the power of their vote based upon their constituencies needs.  We elect people who Americans feel will pay attention and support their issues. Rep. Carney said she felt rotten but when you are responsible for the future of the states well being you don’t have the right to feel bad or rotten as she said.  It is your job to pay attention no matter what time of day or night it is and responsibly vote.

She said it was late after 11 o’clock and she was tired.  “I pushed the wrong button – the green one.”  Even if you’re tired doesn’t green mean go?  Oh she tried as best she could to change her vote but couldn’t – house rules.  I certainly wonder about what really happened, despite her drama on the floor after her green not red voting exercise.

In any case this is the second time the Governor vetoed the bill from the legislators and sent them back to make a change.  And today Carney’s vote has created the opportunity for the fracking industry to exploit North Carolina just as they have in PA, OH and so many western states.

Maybe voters in NC should ask tired Carney to take a break and let someone else take on the tiring effort of working past 11 o’clock in the evening and voting responsibly.

Stop The Madness – You're Hurting Our Children

The future of our country will be the hands of our children.  But what does that mean?  We can raise our children with values and ethics and teach the basic lessons of life, encourage learning and education.  Yet our children and our future children are at risk of not being able to lead our country. Our children risk not being able to succeed in business, in society because of the environmental chemicals that they are exposed to every single day.  Chemicals are leaching from the floors that they crawl on as infants, beds that they sleep on nightly or the toys they play with and put into their mouths, all release dangerous chemicals.  What will their future be like?  How can our country grow and prosper or compete in the global economy?

Recently the Center for Disease our federal health agency reported that 1 out of every 88 American children is affected by autism. That is a 78% increase in autism since 2002 and 23% increase since 2006. As if that is not bad enough, the agency also reports that 14% of American children are affected by Attention Deficit Hyperactivity disorder (ADHD).

Of course not all of these problems are the result of chemicals in a child’s environment but a good percentage are.  Looking at the chemicals that are in every day products, ones that are linked to these particular diseases, it is clear society can prevent the harming of children.  PCBs, for example are fond in our environment, in lighting and windows of schools built before 1980.  Lead is found in toys imported from other countries; paint in older building, homes, play grounds and around various industrial sites.  Brominated flame retardants are in mattresses, pillows, clothing and all types of furniture. Also there are Endocrine disruptors like phthalates found in PVC products that are all around us in flooring, toys, pipes, shower curtains and binds.

Not a single one of these chemicals in products are necessary for life or for comfort.  Every one of them can be taken out of children’s environment today.  We know how, and we know where to find and remove these threats.  We are just lacking the political will.

Our politicians need to stop the madness and find the conviction and courage to stand up to Corporate America and say no more . . .”Our children will no longer be sacrificed.”

If I as a parent deliberately, knowing harmed my child I would go to jail, yet in America corporations are above the law and spend huge amount of money to keep their unsafe product from being eliminated in our marketplace and environment.

Just look at the statistics above or the rising cancer incidence in children across the country.  This is an election year where we have a chance to ask the hard questions and vote out of office those that intend to harm our children to protect corporate interests.  Everyone needs to get involved, today, so that we together can reverse the trend and protect our futures. Ohio Grassroots Call Out Lies of the Ohio Oil and Gas Association

During recent testimony on Ohio Governor Kasich so called “energy bill”, Tom Stewart, vice-president of the Ohio Oil and Gas Association testified that Ohio has the highest quality crude oil known to be produced in the world.  He testified that the crude is highly paraffinic and that they skim off the paraffin at the refineries to make candy out of it and also use it for coating on items like Advil and M&M’s.

Members of Frack Free Ohio sent Mr. Stewart some personalize M&M’s that read “Don’t Frac Ohio, Complements of Frack Free Ohio” and also posted on Mar’s Facebook page demanding to know if it is true that paraffin from crude oil is used to make the coating on M&M’s.  This morning a member of Frack Free Ohio received this from the company;

“Only high quality ingredients that meet or exceed all federal standards are used to manufacture M&M’S® Chocolate Candies. Only materials made from natural plant sources are used to coat the outside of the candies. Any information to the contrary is inaccurate.”

People should go to M&M’s Facebook and ask the company to either admit to using well paraffinic from oil and gas wells or to request a public apology and retraction from Tom Stewart. Here is M&M’s Facebook link http://www.facebook.com/mms

Let me give you a good example. If you have a gas well, that flows naturally, but it produces some water, and if you don’t maintain that well, in such a way, the water will build up and creates hydrostatic weight in the formation and the well will stop producing.

You got a couple ways you can solve that problem. You can go into the well and swab it out, you can try putting pump equipment and get it to pump out, or you can try to get the well to flow again. Here’s how a producer gets it to flow again, he goes to the grocery store and he buys, Tide, and he puts it down the backside of the well which causes it to bubble up and foam up, lighten the fluid and the well flows.

So to ask the question, what do you want me, as a producer, to give you the CAS number of… Tide? ‘Cuz it’s something that’s put down the well and it’s stripped and brought back.

You’re pumping the well (unintelligible) with pump jacks, they’re actuated by separate rods connected to a bottom hole pump where the bottom of the tube is four thousand feet deep in the ground. You’re pumping that well, over time, scale builds up on the balls and seats that actuate the pump. . . You can put scale remover down the, uh, back side of that well, pump it up through the tubing, it eliminates the scale you don’t have to pull the well or the tubing for it pump. Ohio produces, probably the highest quality crude oil known to be produced in the world, it’s Penngrade 38 degree oil.  It’s highly paraffinic, they actually skim the paraffin off in refineries and make candy out of it, they also make, the coatings on Advil and M&M’s, so when you’re eating your next box of M&M’s, you’re eating crude oil.

Autism and Environmental Chemicals

CHEJ has been talking about the dangers of PCB’s in school lighting fixtures and how the chemical can affect children’s health. Last month, the Center for Disease Control (CDC) reported that autism spectrum disorder now affects 1 of every 88 American children — a 23% increase from 2006 and a 78% increase from 2002. CDC also reported that ADHD now affects 14% of American children.

As these disorders continue to affect more children across the U.S., researchers are asking what is causing these dramatic increases. Some of the explanation is greater awareness and more accurate diagnosis. But clearly, there is more to the story than simply genetics, as the increases are far too rapid to be of purely genetic origin.

The National Academy of Sciences reports that 3% of all neurobehavioral disorders in children are caused by toxic exposures in the environment and that another 25% are caused by interactions between environmental factors and genetics. But the precise environmental causes are not yet known.

To guide a research strategy to discover potentially preventable environmental causes, a list of ten chemicals found in consumer products that are suspected to contribute to autism and learning disabilities.

This list was published today in Environmental Health Perspectives in an editorial written by Dr. Philip J. Landrigan, director of the CEHC, Dr. Linda Birnbaum, director of the National Institute for Environmental Health Sciences (NIEHS), and Dr. Luca Lambertini, also of the CEHC.

The top ten chemicals are:
1. Lead
2. Methylmercury
3. PCBs
4. Organophosphate pesticides
5. Organochlorine pesticides
6. Endocrine disruptors
7. Automotive exhaust
8. Polycyclic aromatic hydrocarbons
9. Brominated flame retardants
10. Perfluorinated compounds

The editorial was published alongside four other papers — each suggesting a link between toxic chemicals and autism.

There are things we can do as parents as concerned taxpayer and citizens. First, is to remove chemicals in areas that children frequent. As you may know CHEJ’s Children Environmental Health Program has been working on identifying and the removal PCBs in school lighting fixtures as well as removing other environmental chemicals from children environment such as emissions near schools.

As a humane society we cannot allow this devastating neurological problem to continue to rise in our children. It is time to speak up and out about environmental chemicals and children’s health. It is time to ask our health authorities to explore where children may be being exposed and eliminate that source of exposure. This is especially true in the case of PCBs and school lighting(schools built before 1980 and had no retrofitting) since this is a win win situation. The school district can remove exposure and save money on the energy efficiency of new lighting fixture.

Our children are our future. Let’s protect them . . . our future depends on their leadership.

Local Group Calls for Shutdown of Old Mission Repository

Kellogg, ID: Lead issues have long plagued entire communities as a result of mining, smelting or other production of lead products. One of the worst locations for lead contamination is in the Coeur d’Alene mining district (CDA), Idaho. The Bunker Hill mine was one of the richest lead producing mines in the US. There are hundreds of mines in Shoshone County, Idaho, most are inactive at this time but several that are still mining; this is one of the richest heavy metal mining areas in the world, and has produced billions in mining production.

Bunker Hill is also a Superfund Site, which is a site where toxic wastes have been dumped and the EPA has designated them to be cleaned up. According to the EPA, the Coeur d’Alene-Spokane River Basin contains “significant measurable risks currently exist to humans”. Because of over 100 years of mining impacting the  area, lead contamination in surface water “as much as 90 times exceeds” EPA standards. 300,000 citizens live within a 1,500 square mile area beginning at the Montana border and extending into Washington State, with over 166 miles of CDA River corridor, downstream water bodies, fill areas, adjacent floodplains and tributaries that are contaminated and “the most heavily impacted areas are devoid of aquatic life.”

As a result of the contamination, children in this area have blood lead levels above the national CDC standards.  “One of every four children tested outside the 21 sq. mile “box” is found to have an elevated blood levels and are now lead poisoned. Numerous children in the Bunker Hill site are also still being tested a routine began in about 1974 and are found with elevated lead levels.

EPA planned to address the huge area contaminated with lead by creating a repository. In 2008, the Cataldo Mission, a national historic landmark located in Old Mission State Park became a temporary dumping ground (repository) for tons of lead contaminated soil. The Silver Valley Community Resource Center (SVCRC), a local group, led protests against remediation citing that the repository sits on a flood plain that flood annually, no assurance that regular flooding will not contaminate ground water and wells, and no assurance that toxic run off from the flooding will not reach the N. Fork of the Coeur d’Alene River through seepage or flow continuing to contaminate area.

SVCRC continues to address the failure of the repository and hold EPA accountable for remediation actions. SVCRC wrote a letter to EPA, signed by thousands of citizens, local and national groups opposing the repository and a call to have a permanent clean-up plan. For approximately a year, SVCRC, Sierra Club and Center for Health, Environment and Justice (CHEJ) have pursued requests from EPA and IDEQ staff to provide the scientific data supporting their allegation, “that the water is cleaner after it goes through the (Mission) repository”. To date the agencies have not been able to provide the data to back up this statement.

Recently it was learned from FOIA materials sent by the Dept. of Transportation that the repository is nestled between the Yellowstone petroleum gas line and a natural gas line that has been in place in the area for the past 50 years. Affected citizens are asking the question as to why the pipelines were never made public at any time while the Mission Repository was proposed and developed. The Yellowstone pipeline and the natural gas lines have been in the Mission Repository for five decades. They are accidents waiting to happen with all the heavy equipment that is in operation at the site throughout the year and all the traffic and population that travels Interstate 90 a stone throw from Exit 39 where the 20 acre repository is located.

“Drop in gas pressure, lack of response by EPA to affected community members, CD’A tribal sacred grounds being desecrated, a major wetland being destroyed, National Historic Preservation laws being broken, millions of tons of pollution continuing to be deposited downstream to the Spokane and Coeur d’Alene Rivers, this is not emotional attachment to the Old Mission, this is about EPA’s destruction to the environment and human health risks. EPA needs to move to have this repository shut down, immediately”, said Shane Stancik, lifelong Silver Valley resident, lead poisoned child and SVCRC board member.

SVCRC is continuing its grassroots work to shut down the repository and assist EPA in refocusing its cleanup priorities to protect the environment and human health specific to blood lead testing and intervention.

“Furthermore, the use of child blood lead levels used as a remedial action objective cannot capture the broader dimensions of health and well-being that should be taken into account in remediation efforts. To this end, it should be argued that remediation efforts should not only focus on harm reduction but also contribute to efforts to ameliorate environmental and social injustices. Securing a health future for the residents of the contaminated mine sites, such as Kellogg, requires more than just reducing child blood lead levels; it requires attention to the complex set of factors underlying the pattern of systematic disadvantages that compromise the health and well-being of a post-production, mining community”, Ethical Issues in Using Children’s Blood Lead Levels as a Remedial Action Objective, Moodie, Evans, 2011.

Grassroots Environmental Groups Are The 98%

The environmental movement has spent the last five years trying to protect laws and regulation we have and stop the roll back efforts, while also moving new regulations and policies. However, we are failing. For example, millions of dollars were invested in Climate Change legislation and we failed to move any agenda forward. One reason, according to surveys and polling, is that the American people didn’t know what to do to make a difference (beyond changing their light bulbs) or didn’t see how the issues they cared about connected to climate change. A recent report, published by the National Committee for Responsible Philanthropy, provides some insights of why the average person might have had problems connecting the dots.

The report says, “The movement hasn’t won any “significant policy changes at the federal level in the United States since the 1980s” because funders have favored top-down elite strategies and have neglected to support a robust grassroots infrastructure. Environmental funders spent a whopping $10 billion between 2000 and 2009 but achieved relatively little because they failed to underwrite grassroots groups that are essential for any large-scale change.” Without resources to hold meeting that bring leaders together at the local level, provide training for media opportunities, learn how to develop a strategic plan or provide resources to join other organizations efforts, local organizations cannot sustain themselves nor move beyond the issue that brought them together.

Interestingly, according to the IRS filings, while less and less money is being provided to grassroots effort, grassroots environmental groups are emerging at more than twice the rate of other non profits sector.

More than half of all environmental grants and donations are given to 2% of all environmental groups all with budgets over $5 million. This 2% of really large groups receives more than 50% of all grants! This leaves 98% of environmental groups with less than half the available funds.

This is a serious problem. In movements throughout history, the core of leadership came from a nucleus of directly impacted or oppressed communities while also engaging a much broader range of justice-seeking supporters. In other words, successful movements for social change — anti-slavery, women’s suffrage, labor rights, and civil rights — have always been inspired, energized, and led by those most directly affected. Yet these are the very groups within the environmental movement that are starved for funds.

As the highly-successful right wing in the U.S. can tell you, social movements grow large and powerful only when they are served by a deep infrastructure of organizations offering technical assistance and know-how. Local groups need to be able to find each other, share strategies, develop leadership, communicate their message, identify allies, and gain a wide range of skills. Such an infrastructure requires sustained funding and without it no movement can succeed.

Clearly, CHEJ is not a funder but is an essential part of the infrastructure. In the report NCRP strongly supports infrastructure using CHEJ as one example. “CHEJ provides everything from technical assistance on local advocacy campaigns to small capacity building grants. By nurturing emerging groups and providing ongoing feedback and coaching for more seasoned organizations, while convening meetings and alliances for all groups to connect and work together, CHEJ helps till the soil and spread the nutrients in which grassroots organizing and movement building thrive.”

To create real systemic change somehow we need to figure out how to communicate with those distributing funds that there needs to be a balance. Yes the large groups are very important but in they are only as powerful as the base they represent and can advocate at the local level. All politics, all change are local. It’s not an issue of supporting  either the large groups or the grassroots groups. It is critical to support both with balanced or none of us succeed. My question to the network is how do we communicate this message? Ideas anyone?

Study finds risk to children from coal-tar sealants










Children living next to driveways or parking lots coated with coal tar are exposed to significantly higher doses of cancer-causing chemicals than those living near untreated asphalt, according to a study that raises new questions about commonly used pavement sealants.

Researchers from Baylor University and the U.S. Geological Survey also found that children living near areas treated with coal-tar-based sealants ingest twice as many polycyclic aromatic hydrocarbons (PAHs) from contaminated dust tracked into their homes as they do from food.

The peer-reviewed study, and other new research documenting how coal-tar sealants emit high levels of troublesome chemicals into the air, comes as several cities in the Midwest, South and East are trying to ban the products’ use on playgrounds, parking lots and driveways. Some major retailers have pulled the products from their shelves, but coal-tar sealants remain widely available elsewhere.

“There’s been a long-held assumption that diet is the major source of exposure for children,” said Peter Van Metre, a USGS scientist who co-authored the studies. “But it turns out that dust ingestion is a more significant pathway.”

About 85 million gallons of coal-tar-based sealants are sold in the United States every year, mostly east of the Mississippi River, according to industry estimates. The sealants, promoted as a way to extend the life of asphalt and brighten it every few years with a fresh black sheen, are sprayed by contractors or spread by homeowners.

During the past decade, studies have identified coal-tar sealants as a major source of PAHs, toxic chemicals that can cause cancer and other health problems. Pavement sealants made with coal tar can contain as much as 50 percent PAHs by weight, substantially more than alternatives made with asphalt.

Anne LeHuray, executive director of the Pavement Coatings Technology Council, an industry trade group, said she was reviewing the new findings.

“It appears they have some other agenda here, which is to ban coal-tar-based pavement sealants,” she said of the government scientists.

LeHuray and other industry representatives have argued that vehicle exhaust, wood smoke and grilled hamburgers are more significant sources of the toxic chemicals than coal tar.

But the latest USGS research estimates that annual emissions of PAHs from the application of coal-tar-based sealants exceed the amount from vehicle exhaust. Two hours after application, emissions were 30,000 times higher than those from unsealed pavement, one of the new studies found. Parking lots with 3- to 8-year-old sealant released 60 times more PAHs to the air than parking lots without sealant.

Chicago, We have a Problem! Another School Siting Gone Bad

Since 2000, CHEJ’s Childproofing Our Communities (CPOC) campaign has been working on environmental school based issues and specifically school siting. What is school siting? School Siting is the process of where to locate a school facility. For decades this has been a contentious problem for decision makers because often where to place a school can be influenced by the budget. Decision makers have been enticed into purchasing ridiculously low cost land or property often not taking into consideration the cost to remediate or clean-up any toxic contamination. This oversight has cost school districts extra millions of dollars to clean-up site and even more because often on-going monitoring must be put in place.

There have been many examples of poor planning of where to place a school. The Belmont Learning Complex in Los Angeles was built on top of a former oil field full of explosive and toxic gases and other contaminants. The full environmental assessment was not completed until after $123 million was already put into the project. The site was them abandoned due to the health and safety concerns. A new school was built after a thorough cleanup. Over $300 million was spent on the project!

Now in Chicago there are plans to locate an elementary school on contaminated land in an industrial area. The proposed site is near a power plant and in an area already documented to have the state’s highest levels of toxic chromium and sulfates, a hazardous air pollutant and probable human carcinogen. The economic advantage that school boards hope for with the purchase of a contaminated site is rarely as beneficial as designed. Often the ones who have very little input in the process suffer the most, children. The community can have input in this process by making sure your state have some type of school siting policy. In October 2011, the EPA released its School Siting Guidelines to assist school districts in assessing environmental factors when deciding where to place a school. Although guidelines  does not pertain to existing schools, it can be used as a tool to enact a policy in your area and assess existing schools for potential environmental hazards.
