EPA Switches Stance on Testing Lead in Drinking Water

The fiasco in Flint, MI has forced an important change in EPA’s recommended protocols for testing lead in drinking water. In a memo to state health and water administrators issued February 29, 2016, the US EPA reversed its prior recommendations on how to sample drinking water targeted for lead testing. The new protocols are as follows:

  • Do not remove or clean faucet aerators prior to collecting samples
  • Do not pre-flush prior to sampling
  • Use wide mouth sample bottles to allow water flow to enter at a rate similar to what consumers might use when pouring a glass of water to drink

In the past, EPA‘s advice was to pre-clean the aerator, flush pipes prior to sampling, and open the tap slowly and sample at low flow. Using these guidelines results in less particulate lead getting into the sample and thus finding lower lead concentrations in the water. Removing or cleaning an aerator prior to testing masks the added contribution of lead at the tap that results from the lead in the aerator. Flushing the pipe prior to sampling eliminates the lead that has built up overnight or since the last time the faucet was used. Pouring the water slowly, whether by using a narrow container or by just opening the tap slowly, also reduces particulate lead that gets into the water by not disturbing lead present in the pipe as much as a normal flush would. These inaccurate procedures were called to task by Dr. Marc Edwards from Virginia Tech University who found high levels of lead in the drinking water in Flint, MI.
Despite the fact that this is not what people typically do when they pour a glass of water from the sink to drink, these are the sampling procedures that EPA has been advocating for years and what water companies have been using for years to measure lead in drinking water. By using these procedures, water companies everywhere, not just in Flint, are not accurately measuring the lead concentration in drinking water, and they are potentially missing a significant portion of the lead actually in the drinking water systems. Doing this provides a false sense of security that seriously endangers public health.
Although EPA has issued these new guidelines, there’s no guarantee that water companies around the country have switched to the new sampling procedures. If you’re concerned about the lead levels in your water, find out what sampling procedures are being used because it makes a huge difference. While we can thank the public attention given to the disaster in Flint for this critically important change, now we need to make sure that testing agencies across the country follow this new protocol. ATSDR Fails Community Once Again

In July of 2013, an explosion occurred at the WTI/Heritage Thermal Services (HTS) hazardous waste incinerator in East Liverpool, OH. Incinerator ash that had built up on the inside of the incinerator stack suddenly fell off causing a huge cloud of dust contaminated with heavy metals and other toxic substances to be released from the stack. An estimated 800 to 900 pounds of ash were released into the surrounding community. The plant manager advised residents to wash fruits and vegetables from their gardens and to replace food and water for pets and farm animals. Save Our County, a local group that has been fighting to shut down the incinerator for more than 20 years and other local residents were quite alarmed by what happened and asked whether this latest accident further put their health at risk.

The state regulating agency’s response was to invite the federal Agency for Toxic Substances and Disease Registry (ATSDR) to evaluate what risks the residents might have suffered. More than a year later, ATSDR released its report which concluded that the “trace amount of toxic metals in the surface and subsurface soils of the residential area west of the HTS facility affected by the July 2013 ash release are not expected to harm people’s health. The reason for this is that the concentration of these metals found in the soils are below levels of health concern.”

It’s not clear how ATSDR came to this conclusion when some of the data included in the report clearly show contaminant levels that exceeded levels of health concern. Two (of 13) soil samples, one on-site and one off-site, both downwind, had the highest levels of contaminants of concern (though they never disclosed what these levels were). The arsenic levels found in the surface soil of the surrounding community generally exceeded public health levels of concern, ranging from 14 to 57 parts per million (ppm), averaging 20 ppm. The public health level of concern is 15 ppm.

There is also data on two wipe samples (of 8) collected by HTS immediately after the accident that were found to contain 3,600 ppm arsenic; 13,000 ppm lead and 8,000 ppm nickel. These samples were collected from areas on-site where trucks at the facility were staged. These are all extraordinarily high and well above public health levels of concern.

Similarly, two wipe samples collected from the community had arsenic levels at 277 ppm and lead at 819 ppm, both levels well in excess of levels of public health concern. The report refers to a third sample collected from the surface of a black S10 pick-up truck with arsenic at 296 ppm and lead at 1,046 ppm also well above public health levels of concern.

Despite all of these results that exceeded public health levels of concern, ATSDR concluded that there is no cause for alarm and that the toxic metals released into the community “is not expected” to harm people’s health. It’s like someone at ATSDR wrote the conclusion without ever reading the report or looking at the data.

The ATSDR report simply ignores the data that exceeds public health levels of concern and draws its conclusions as though these high levels did not exist. How can anyone trust a government agency that operates this way?

This is what communities across the country have grown to expect from ATSDR – conclusions that are unresponsive to community concerns about potential health risks but protective of industrial pollution. Some things never change.

Guest Blog: Fracking Impacts Without Drilling

In talking about ‘fracking’, oftentimes the industry tries to limit the discussion to the actual process of injecting liquid at high pressure into rock formations to extract gas. However, there is a broad network of infrastructure that is required to support that process, including storage facilities, compressor stations, metering stations, processing facilities, gathering lines, and intrastate and interstate pipelines. And regulatory oversight of those components falls to various local and federal agencies, if it is regulated at all. Very generally speaking, activities related to drilling fall under state authority while the federal government has oversight of interstate pipelines and associated facilities.  And what that means for towns like Myersville is that while there is currently no fracking in Maryland, the natural gas boom has already negatively affected our community.

Myersville is a picturesque rural community of approximately 1,600, nestled in the Middletown Valley of Frederick County, MD about 40 miles north of Washington, DC. It is a place where families have lived for generations and where newcomers have settled, seeking the serenity and closeness a small town offers.

And it is here, approximately 1 mile from our only elementary school that Dominion Transmission (DTI), a subsidiary of Virginia-based power giant Dominion, sought to build and operate a 16 thousand horsepower natural gas compressor station to move gas along its interstate pipeline. This station would annually release 23.5 tons per year of Nitrogen Oxides in addition to particulate matter, volatile organic compounds, carbon monoxide, and green houses gases.

The citizens of Myersville were overwhelming opposed to this plan. We held rallies, wrote over 600 opposition letters, hired an attorney, and formed a community group.

In August of 2012, the Town Council unanimously voted against Dominion’s application to amend the Town Master Plan, finding among others things that the project posed a risk to the citizens.  And by doing so, the Town denied Dominion the necessary local zoning approval required by Maryland Department of the Environment to issue an air permit.  Despite all of this, in December of 2012, the Federal Energy Regulatory Commission or FERC authorized the project.  Armed with that certificate, DTI sued both the Town of Myersville and MDE, using the power of federal preemption granted in the Natural Gas Act to override local and state zoning.

FERC is an independent regulatory agency within the US Department of Energy with jurisdiction over interstate electricity sales, natural gas pricing, and oil pipeline rates.  It also reviews and authorizes liquefied natural gas (LNG) terminals, interstate natural gas pipelines and hydropower projects. The   Commission is composed of five embers, or Commissioners, who are appointed by the President and

In spite of our best efforts, as you enter Myersville, you are greeted by Dominion’s toxic-emission spewing gas compressor station. And while Myersville may be one of the first communities in Maryland impacted by build out from fracking, I can assure you it will not be the last. Already, our friends in Cove Point, MD are battling the LNG export plant and Williams Transco seeks approval to increase compression capabilities in Howard County. In fact, an industry group states that to support natural gas drilling nationally, they will need PER YEAR for the next 25 years1:

•           850 miles of new natural gas transmission mainlines,

•           Over 800 miles of new laterals to and from power plants, processing facilities and storage fields

•           14,000 miles of new gas gathering lines

•           More than 580,000 hp for pipelines and gathering compression

To put that into perspective, here is a 2008 map of natural gas pipelines and compressor stations.



So when we discuss fracking, we need to consider all the impacts associated with it– from drilling rigs, compressor stations, pipelines, processing plants, storage facilities and export plants.  We must not allow separate regulatory schemes to divide and conquer us.  Because what happens to our neighbors in West Virginia, in Pennsylvania, in Ohio, in Western MD, in Myersville, in Howard County, in Lusby, affects all us.

Love Canal activist Lois Gibbs joins R.I. effort to keep law on school siting strong

PROVIDENCE — In 1978, Lois Gibbs took on the powers-that-be when she learned that her son’s school and Love Canal neighborhood in New York were built on a toxic waste dump. Her battle led to the evacuation of hundreds of houses, sparked a massive environmental cleanup, and inspired a made-for-TV movie and the creation of the federal Superfund program.

On Wednesday, 35 years later, Gibbs climbed the steps of the State House to congratulate Rhode Island for enacting what she called the nation’s strongest law against building schools on contaminated sites. She has taken the 2012 bill to Michigan, Massachusetts and New York to promote it as a model.

So why, she asked, would anyone want to “undo the best piece of legislation in this country? … It’s less than a year and already they are trying to tear up the law.

“Why,” she continued, “would people want to put Love Canal beneath a school?”

Gibbs, having learned of the attempt to weaken the law, traveled from Virginia to lend her experience and fame to support the year-old law prohibiting school construction where toxic vapors pose a risk. She joined the rally organized by the Environmental Justice League of Rhode Island, Clean Water Action, and the Childhood Lead Action Project.

The groups lobbied for several years for the so-called “school siting law” after losing a fight to stop Alvarez High School from being built on the former Gorham Manufacturing property in Providence. They were not satisfied with the pollution control systems installed at Alvarez.

Under the law, a school cannot be built on land where vapors from contaminants could potentially infiltrate a new building through cracks and holes. The source of the vapors must be removed or a different site chosen.

But if the law is amended as proposed in House and Senate bills, it would permit the use of engineered solutions that the activists oppose as unreliable and costly to maintain for taxpayers — dollars that could otherwise be spent on education.

The understanding of toxic vapors is “a new science,” said Jamie Rhodes, director of Clean Water Action. “There’s no need to make kids guinea pigs.”

Gibbs, who in 1981 founded the Center for Health, Environment and Justice in Virginia, said both of her children became ill from Love Canal.

“We got sick not from the dump itself,” she said. “We got sick from vapor intrusion.”

The bills were drafted after the Rhode Island Mayoral Academies raised concerns about the law. The organization’s efforts to turn the site of the former Red Farm Studios greeting card company in Pawtucket into another Blackstone Valley Prep Charter School were halted when the law was enacted last year.

Advocates Protest Legislation Allowing Schools on Toxic Sites

Environmental advocates gathered at the Statehouse Wednesday to protest legislation that would roll back restrictions that prevent schools from building on toxic sites.

The woman who helped lobby for the federal superfund program, Lois Gibbs, spoke to a small group of demonstrators on the capitol steps. Gibbs brought attention to the Love Canal toxic site in Upstate New York back in the 70s. She is lending her star power to fight legislation that would allow schools to be built on sites where toxic vapors could be present. She said the bill would gut a new state law that serves as a national model.

“The current legislation that you passed, that they are trying to gut or change, is extraordinary, absolutely extraordinary.”

Gibbs said that legislation established the most stringent school building codes in the nation. A main sponsor of the legislation allowing school construction on sites with possible toxic vapors, Representative John Edwards of Tiverton, did not return our phone calls. Rhode Island Mayoral Academies support Edwards’ legislation. It says it would allow them to convert the former Red Farm Studios in Pawtucket into another Blackstone Valley Prep Charter School. The environmental advocacy group, Clean Water Action, says work was put on hold due to toxic substances found at the site.

A Circle of Poison and Poverty

Imagine for a moment that you live in a community that is poor. You work every day in the service industry but just can’t make enough money to move to a better neighborhood. Now imagine that you have a young child who is gifted with high level of intelligence. You want to send your child to a school that can challenge her to help reach her potential. But, you can’t because of your limited income.

This is how one mother described her situation to me recently in Detroit, Michigan. She went on to say that the area around her home and school had lead levels, left over from former lead smelter activities, which were three times the legal standard. Her child and her neighbor’s children began their lives with so much potential. Today, the children are lead poisoned and are having difficulty passing the state school standardize tests. In fact, so many children are failing the standardized tests that their school is about to be closed, their teachers fired and their community further impacted by another empty building and no neighborhood school.

When people hear about the struggles in environmental justice communities they often only think about the immediate pollution and health impacts in a low wealth community. But to understand it one level deeper you need to understand that families living in these communities are really trapped. If you were only to look at their children’s ability to get out of poverty and reach the birth potential, it speaks volumes about the real world situation.

Their children cannot reach their potential because they are impacted by the chemicals like lead in their environments. Often young people, because they are frustrated in trying to achieve in school while faced with asthma, learning disabilities, and the inability to maintain attention students end up dropping out of school. Students weren’t born with the inability to achieve; it was due to their exposures to lead and other toxic environmental chemicals that they developed problems. Once students drop out of school they have little ability to improve their economic status and thus continue the family’s legacy of poverty.

Those who have the power to change this cycle of poison and poverty choose not to. Instead they cover their intentional neglect by blaming the victims, the parents, teachers, and community leaders. Not only do those in power blame the innocent, they exasperate the problem by ignoring the existing pollution while placing more polluting faculties in the area. I think it was Mayor Bloomberg who said, “Do you really want me to put that smokestack in downtown Manhattan?” when community leaders near NYC navy yard objected to an incinerator being added to their burdens.

I’m not sure how to change this situation. It is a larger societal crisis that will take the majority of people to demand change. Today it is only the voices of the desperate parents, frustrated teachers that sound the alarm and cry for justice. This must change.

Teachers and Students That Inspire

I was invited by a science teacher Kendall Jensen to visit with her students at Roosevelt High School during my travel to assist the Portland, Oregon community group Neighbors for Clean Air. I have visited classrooms often throughout my work at CHEJ. However, this school, its teachers and the students truly inspired me in a way that I left more energized than when I came.

To understand why, you need to understand the environment. The school built in 1921 houses over 680 students. The students come from a low wealth area with 84% of the students receiving free or reduced lunch program, making it Oregon’s poorest high school. A few of the students live in the shelters and are homeless.

Moreover, the school is the most diverse in the state with the student population consisting of 31% Latino, 30% white, 23% African American, 9% Asian/Pacific Islander, and 4% Native American. In a school population where there are so many negative impacts working against students’ ability to succeed, I walked into a room full of students gathered together to take steps to improve themselves and their environment.

Ms. Kendall Jensen a science teacher at the high school has inspired and motivated the students to explore the environmental problems in the community. As I walked into the classroom where we were having lunch and conversation with students about Love Canal and the work that the neighborhood group, Neighbors for Clean Air, was working on the room was full of energy from eager students. No one was getting extra credit; no one was getting any benefit other than the opportunity to learn more about their neighborhood’s air problems.

I would be remiss if I didn’t also share that this was one of the first beautiful spring days in Portland with the temperature in the 70’s, sunny and clear. Yet students motivated by Kendall and their own curiosity came to learn instead of joining their friends for lunch on this beautiful day. Students listened and learned not just about the local toxic air pollution problems but about taking leadership becoming their own advocates and standing up for what they think is right. This High School is in the direct line of toxic air pollution. It is one of Portland’s schools that rank in the top 5% of all US schools with the most dangerous outdoor air quality in the country.

As a mother of four and someone who has spent time with extraordinary teachers like Kendall, it is clear that when students fail it is not because of a failed teacher. Sometime, especially in schools like Roosevelt High School where students face challenges everyday to survive, it the added toxic environment that directly affects their ability to learn and to pass standardized tests. We know with a level of scientific confidence that toxic chemicals in the environment are directly connected to children’s’ ability to concentrate and learn. Children facing daily toxic lifestyles as it is being referred to now – meaning single family households, poverty, drug influences, poor diet and so on – is exasperated by exposures to real toxic chemicals. Clearly the students in that classroom want to learn, want to succeed and want to take control of their futures. They and the school’s teachers need help; they need a healthy environment, with clean air for their students to succeed. Clean air is something that teachers do not have the ability to change on their own. It is the responsibility of the government to give students a chance by both providing the tools and the healthy environment to make success possible. If the students at this school fail it is more likely the fault of the lack of a healthy environment and not the teachers.

Health Impacts of Mountaintop Removal Mining

Earlier this week, CHEJ released a report on the Health Impacts of Mountaintop Removal (MTR) Mining. This report reviewed the most significant studies on the human health impacts of MTR mining. The health studies described in this report provide strong evidence that MTR mining has impacted the residents in the surrounding communities and that further research is needed to better understand the relationship between adverse health effects and MTR mining.

The studies reviewed in this report show that MTR areas have higher rates of cancer, cardiovascular disease-related mortality, overall mortality, and birth defects, and that the residents of these areas report lower health-related quality of life than residents of any other part of Appalachia.

As part of this report, we commissioned a group of medical and scientific experts called the National Commission on Health Impacts of Mountaintop Removal Mining and asked them to review this report. Commission members included Dr. Jerome Paulson, Professor of Pediatrics & Public Health, George Washington University; Dr. Steven B. Wing, Associate Professor of Epidemiology, School of Public Health at the University of North Carolina in Chapel Hill; and Dr. Daniel Wartenberg, Professor of Environmental Epidemiology and Statistics, Environmental and Occupational Health Sciences Institute at the Robert Wood Johnson Medical School in Piscataway, New Jersey.

The Commission strongly supported the findings in the report and developed recommendations to improve our understanding of the interactions between MTR mining and human health. The main recommendation called for “an immediate moratorium on MTR mining until such time as health studies have been conducted that provide a clearer understanding of the associations between adverse health impacts, notably adverse reproductive outcomes, and MTR mining.  In addition, during the moratorium period, appropriate safeguards including remediation and engineering controls should be implemented to mitigate air and water pollution related to MTR mining activities.”

The actions called for by the Commission are in line with recent government initiatives to protect the health of Appalachian communities. In February 2013, Congressional Representatives re-introduced the Appalachian Community Health Emergency Act (ACHE Act, HR 526. If passed this bill would require the Department of Health and Human Services to lead a federal investigation of the reported links between MTR mining and human health impacts. Until such an investigation is conducted, the ACHE Act would require a moratorium on all new MTR permits, as well as on any expansion of existing permits. The ACHE Act would address the primary recommendation of the Commission which is to place an immediate moratorium on MTR mining until such time as health studies have been conducted that provide a clearer understanding of the associations between adverse health impacts and MTR mining

NY PTA Passes Resolution to Phase-out PVC in Schools

The New York State Parents Teachers Association (PTA) voted last week at their annual meeting in Saratoga Springs, NY to pass a resolution calling for a phase out of the plastic PVC in schools. The resolution, called “Reducing & Phasing Out the Purchase of Polyvinyl Chloride (PVC) Plastic in New York Schools,” acknowledged the serious harm posed by PVC throughout its lifecycle, releasing toxic chemicals such as phthalates during use in products such as school supplies and building materials; releasing toxic chemicals such as vinyl chloride and ethylene dichloride during manufacture; and generating toxic chemicals such as dioxins during disposal when burned.

The PTA’s resolution recognized that chronic health problems and conditions in children linked to environmental exposures are on the rise, including learning and developmental disorders; that children are uniquely vulnerable to harm from toxic chemicals such as those released by PVC; that PVC materials and products contain toxic additives, including volatile organic compounds (VOCs) and phthalates, that may be released into the indoor environment, posing hazards to human health including asthma and developmental problems and that children are at greatest risk of exposure; that PVC is commonly found in office supplies and building materials used in schools; that safer, cost-effective alternatives to PVC products are readily available for schools; and that the U.S. Green Building Council provides incentives for schools to avoid PVC and phthalates in “green schools.”

The NYS PTA resolution calls for the following actions:

  • Resolved that the New York State Congress of Parents and Teachers, Inc. seek and support legislation that would reduce and phase out the use of PVC products at all New York State school facilities; and be it further
  • Resolved that the New York State PTA urge school districts and the New York State Education Department (NYSED) to develop green procurement policies to reduce and phase out the use and purchase of PVC building materials and office and education supplies in school facilities where safer cost effective alternatives are available; and be it further
  • Resolved that the New York State PTA and its constituent units educate parents and community members about the potential health effects of PVC and work to eliminate PVC products at all PTA-sponsored events; and be it further
  • Resolved that the New York State PTA forward this resolution to the National PTA for its consideration.

This resolution adds to the growing movement for PVC-free schools and follows similar resolutions enacted by the American Public Health Association (APHA), the “oldest and most diverse organization of public health professionals in the world,” last year and by the New York State United Teachers (NYSUT) union that represents more than 600,000 employees and retirees from New York State schools, colleges, and healthcare facilities, this past summer. When our children are sent off to day care – are they breathing in toxic phthalates?

When considering day care, more than a few related topics could come to mind: children, toys, play, and a safe environment are probably some to just name a few. However, although children at day care may be under the supervision of responsible adults and having a great time with their playmates, they may be at risk for a danger most parents would have no idea about — toxic chemicals in the day care environment.

A new study of day care centers found a toxic cocktail of chemicals lurking in the air and dust, including phthalates, chemicals that are so toxic they’ve been banned in toys across the globe.

The research, funded by the California Air Resources Board (CARB), is the first-ever detailed analysis of environmental contaminants and exposures for California day care centers. It covered 40 early childhood education facilities.

“Children are more vulnerable to the health effects of environmental contaminants, and many small children spend as much as 10 hours per day, five days a week, in child care centers,” said study lead author Asa Bradman, associate director of the UC Berkeley Center for Environmental Research and Children’s Health (CERCH).

Phthalates Widespread in Daycare Centers

Phthalates are chemicals commonly used to make vinyl building materials such as flooring soft and flexible.  These building materials are commonly used in schools and day care centers, even though safer biobased alternatives like linoleum are available.

In the new study, phthalates were found in 100% of the air and dust samples inside daycare centers.  The report noted that,

“Phthalate compounds, detected in 100% of the air and dust samples, have been shown to disrupt normal hormone function in animals. There are no health-based benchmarks to evaluate phthalate levels in air. Of all compounds measured in dust, the highest were the phthalates di(2-ethylhexyl) phthalate (DEHP) and butyl benzyl phthalate (BBP), with medians of 172.2 and 46.8 μg/g, respectively.”

Oy.  Every single sample.

Phthalates have no place inside day care centers or schools, and are brought to us by BIG CHEM.  They are harmful to children’s health.  The researchers stated that

“Phthalate compounds are on the California Proposition 65 list as developmental toxins, and have been found to contaminate indoor environments.Studies have associated phthalate exposures with bronchial obstruction, allergies, and asthma in young children, and they are likely endocrine disruptors in humans.”

US EPA: Children Face Highest Exposures to Phthalates

According to the EPA,

“Data from the National Health and Nutrition Examination survey (NHANES) indicates widespread exposure of the general population to phthalates. Biomonitoring data from amniotic fluid and urine have demonstrated that humans are exposed to phthalates in utero, as infants, during puberty, and in adult life, and that people are exposed to several phthalates at once…NHANES detected a DEHP urinary metabolite in 78% of the 2541 samples tested with women having a higher exposure than men. Children have been reported as having the highest exposures; specifically to DEHP, DBP, BBP and DnOP…Children are exposed to phthalates through environmental sources (e.g., air, water, food) as well as consumer products (e.g., toys)…Children’s estimated exposures are often greater than those in adults which may be due to increased intakes of food, water, and air on a bodyweight basis, as well children’s unique exposure pathways such as mouthing of objects and ingestion of non-food items. The 1999-2000 and 2001-2002 biomonitoring data in the Third National Report on Human Exposure to Environmental Chemicals demonstrate that children have the highest exposures to phthalates of all groups monitored, and other biomonitoring data indicate in utero exposures to phthalates.”

Phthalates Banned in Toys in the US and Around the World

Phthalates were banned in toys in the United States in 2008.  Similar bans have been enacted by the states of California, Washington and Vermont.

Restrictions or bans have been placed on phthalates in PVC toys in the entire European Union, Austria, Denmark, Finland, France, Germany, Greece, Italy, Japan, Iceland Mexico, Norway, and Sweden.

While phthalates have been banned in toys, similar protections do not exist for day care centers and our schools.
